		  Secretary of Veterans Affairs to use electronic communication to provide
		  required notice to claimants for benefits under laws administered by the

		<section id="HC2C15C2EFB9148BB86981358E18B3732" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Modernizing Notice to Claimants
			 Act</short-title></quote>.</text>
		</section><section id="H35F504066CC640ADBE8642D85D62E7DE"><enum>2.</enum><header>Authorization of
			 use of electronic communication to provide notice to claimants for benefits
			 under laws administered by the Secretary of Veterans Affair</header><text display-inline="no-display-inline">Section 5103 of title 38, United States
			 Code, is amended—</text>
			<paragraph id="H8EEDF5DA825E43FBAC6FD49A98FB6FE6"><enum>(1)</enum><text>in subsection
			 (a)(1)—</text>
				<subparagraph id="H34EE5E76BAC14006812F31FA52C449D1"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Upon receipt of a
			 complete or substantially complete application, the</quote> and inserting
			 <quote>The</quote>;</text>
				</subparagraph><subparagraph id="HCE96B88E72984DEE9BB28BDE7EFBB818"><enum>(B)</enum><text>by striking
			 <quote>notify</quote> and inserting <quote>provide to</quote>; and</text>
				</subparagraph><subparagraph id="H283E2AF46A4849BF93A0B05B7117F467"><enum>(C)</enum><text>by inserting
			 <quote>by the most expeditious means available, including electronic
			 communication or notification in writing</quote> before <quote>of any
			 information</quote>; and</text>
				</subparagraph></paragraph><paragraph id="HDC47A4DB2E764475966BD2A8F82D1743"><enum>(2)</enum><text>in subsection (b),
			 by adding at the end the following new paragraphs:</text>
				<quoted-block display-inline="no-display-inline" id="H6C31F556F3DA4B948BE9A2C92AC975D1" style="USC">
					<paragraph id="H25D23B08B43E462EB367CE276725CEAA" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Nothing in this section shall require the
				Secretary to provide notice for a subsequent claim that is filed while a
				previous claim is pending if the notice previously provided for such pending
				claim provides notice of the information and evidence necessary to substantiate
				such subsequent claim.</text>
					</paragraph><paragraph id="H6B35797A56864B7DA9BF2E60A32CA7BC" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">This section shall not apply to any claim
				or issue where the Secretary may award the benefit sought based on the evidence
				of
				record.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HB6FDEB03361F41BCB6574B3E18740985"><enum>3.</enum><header>Duty to assist
			 claimants in obtaining private records</header>
			<subsection id="H1252570081F94EB69D35905ABD279235"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 5103A(b) of
			 title 38, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H746825585138462EB9B55BD9919EE3CD" style="USC">
					<subsection id="H46729E813F5A41B3BC9CD845BEEBC1EC"><enum>(b)</enum><header>Assistance in
				obtaining private records</header><paragraph commented="no" display-inline="yes-display-inline" id="H30DCAA5CA8954FC59061F61BF052F15E"><enum>(1)</enum><text>As part of the
				assistance provided under subsection (a), the Secretary shall make reasonable
				efforts to obtain relevant private records if the claimant requests assistance,
				in a manner prescribed by the Secretary, in obtaining such records.</text>
						</paragraph><paragraph display-inline="no-display-inline" id="HC0BF61516EB046919939F51D27361F7A" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HF1161396674640B68250A8226B687F34"><enum>(A)</enum><text>Whenever the Secretary,
				after making such reasonable efforts, is unable to obtain all of the relevant
				records sought, the Secretary shall notify the claimant that the Secretary is
				unable to obtain records with respect to the claim. Such a notification
				shall—</text>
								<clause display-inline="no-display-inline" id="H76ADFBA01EC84F379102631C9CD25AD1" indent="up1"><enum>(i)</enum><text>identify the records the Secretary is
				unable to obtain;</text>
								</clause><clause display-inline="no-display-inline" id="H3A059731BAD04664AB603738980C829C" indent="up1"><enum>(ii)</enum><text>briefly explain the efforts that the
				Secretary made to obtain such records; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H315507892B234421A6A609AA55D317A6" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">explain that the Secretary will decide the
				claim based on the evidence of record but that this section does not prohibit
				the submission of records at a later date if such submission is otherwise
				allowed.</text>
								</clause></subparagraph><subparagraph commented="no" id="H2C297B72BD1E456882D2F07546DD74BF" indent="up1"><enum>(B)</enum><text>The Secretary shall make not less
				than two requests to a custodian of a private record in order for an effort to
				obtain relevant private records to be treated as reasonable under this
				section.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HC8B5058410E845898096882B000DEA3C" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">This section shall not apply if the
				evidence of record allows for the Secretary to award the benefit sought.</text>
						</paragraph><paragraph commented="no" id="HC89BB5A44FFA4E0B8BA97B61C04A9143" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Under regulations prescribed by the
				Secretary, the Secretary shall encourage claimants to submit relevant private
				medical records of the claimant to the Secretary if such submission does not
				burden the claimant.</text>
						</paragraph><paragraph commented="no" id="H839F3410E44D4C27A33D3BE58EA5D733" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The claimant may waive any requirements
				under this
				section.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H02D8C55D21D5477DA32CA67C21C43687"><enum>(b)</enum><header>Public
			 records</header><text display-inline="yes-display-inline">Section 5103A(c) of
			 such title is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H0116301C54C345C586ECA8222A0DA574" style="USC">
					<subsection id="H8697B786952344B785B9D29D639B1B44"><enum>(c)</enum><header>Obtaining
				Records for Compensation Claims</header><paragraph commented="no" display-inline="yes-display-inline" id="HB09D4D749AB2466388C4E4672123D63E"><enum>(1)</enum><text>In the case of a claim
				for disability compensation, the assistance provided by the Secretary under
				this section shall include obtaining the following records if relevant to the
				claim:</text>
							<subparagraph id="HDE2ECC58F57F4637B4BCEAAFEA312EAD" indent="up1"><enum>(A)</enum><text>The claimant's service medical records
				and, if the claimant has furnished the Secretary information sufficient to
				locate such records, other relevant records pertaining to the claimant's active
				military, naval, or air service that are held or maintained by a governmental
				entity.</text>
							</subparagraph><subparagraph id="H146DF529BBE44882B58F9A960178A96F" indent="up1"><enum>(B)</enum><text>Records of relevant medical treatment
				or examination of the claimant at Department health-care facilities or at the
				expense of the Department, if the claimant furnishes information sufficient to
				locate those records.</text>
							</subparagraph><subparagraph id="H77967C8644044D37B1797F12C0C8CA67" indent="up1"><enum>(C)</enum><text>Any other relevant records held by any
				Federal department or agency that the claimant adequately identifies and
				authorizes the Secretary to obtain.</text>
							</subparagraph></paragraph><paragraph id="HCE55A90AA1634A4FBF7446A193EA1502" indent="up1"><enum>(2)</enum><text>Whenever the Secretary attempts to
				obtain records from a Federal department or agency under this subsection, the
				efforts to obtain those records shall continue until the records are obtained
				unless it is reasonably certain that such records do not exist or that further
				efforts to obtain those records would be
				futile.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
