		  informational calls to mobile telephone numbers, and for other

		<section id="HC311F339019A411C86C75C7B627A0074" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Mobile Informational Call Act of
			 2011</short-title></quote>.</text>
		</section><section id="H09C11DCC19434E5C9F5169B8661F19FB"><enum>2.</enum><header>Definitions</header>
			<subsection id="H165C75AB7C9D448E8863FB2451396778"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 227(a) of the
			 Communications Act of 1934 (47 U.S.C. 227(a)) is amended—</text>
				<paragraph id="HA2BE48D6A6F84B97B62FC57BD31C4FD8"><enum>(1)</enum><text display-inline="yes-display-inline">by amending paragraph (1) to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="HC31DA493F388446BA640FD46FD59667D" style="OLC">
						<paragraph id="H075B02ADFC10466897EBC12ADD8F2939"><enum>(1)</enum><text>The term
				<quote>automatic telephone dialing system</quote> means equipment which uses a
				random or sequential number generator to produce telephone numbers to be called
				and to dial such
				numbers.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H53BEA30BD51F40FAABFF97F7704F9EC8"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
					<subparagraph id="HF9F07033DE3F438FB2E54B4D77A0C01C"><enum>(A)</enum><text>by striking
			 <quote>subsection (b)(1)(C)(i)</quote> and inserting <quote>paragraph (3) and
			 subsection (b)(1)(C)(i)</quote>;</text>
					</subparagraph><subparagraph id="H9F1B616B15A64BF888D198CBEE7F21EC"><enum>(B)</enum><text>in subparagraph
			 (A), by striking <quote>; and</quote> and inserting a semicolon;</text>
					</subparagraph><subparagraph id="H3144A62F244D4231AA757CD784DAE208"><enum>(C)</enum><text>in subparagraph
			 (B), by striking <quote>paragraph (2)(G)).</quote> and inserting
			 <quote>subsection (b)(2)(G); and</quote>; and</text>
					</subparagraph><subparagraph id="H995E6BDB297745519ED550CAB2744FF5"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HEA683664790140B3828CFC822D1FE172" style="OLC">
							<subparagraph id="HFF2B5212D88345549588C12418048FE5"><enum>(C)</enum><text display-inline="yes-display-inline">this paragraph shall not apply for purposes
				of determining whether an established business relationship exists for purposes
				of prior express consent to a call that is a telephone
				solicitation.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HB8E4795F45254BAF9094F1709294E3A2"><enum>(3)</enum><text>by redesignating
			 paragraphs (3) through (5) as paragraphs (4) through (6), respectively;
			 and</text>
				</paragraph><paragraph id="H0DC865C94C594C528E22CD73440A5B62"><enum>(4)</enum><text>by inserting after
			 paragraph (2) the following:</text>
					<quoted-block id="H155DAA94CB9343358F3701C8539D0D18" style="OLC">
						<paragraph id="H3425F75F1C704DE89539A1F96B937F6F"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>prior express
				consent</quote> means the oral or written approval of a person—</text>
							<subparagraph id="HBA2FD65C9206490DADD5EB14A00B997B"><enum>(A)</enum><text>for the initiation
				of a telephone call to such person by or on behalf of an entity with which such
				person has an established business relationship; and</text>
							</subparagraph><subparagraph id="H3DC19137CAB8404CA96D3826F97FAE34"><enum>(B)</enum><text>that is provided
				when such person purchases a good or service or at any other point during such
				relationship.</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">A person
				who provides a telephone number as a means of contact evidences consent under
				this
				paragraph.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4EE487E34AC440CAB2CB861D1D3DB83A"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section
			 227(c)(1)(D) of the Communications Act of 1934 (47 U.S.C. 227(c)(1)(D)) is
			 amended by striking <quote>subsection (a)(3)</quote> and inserting
			 <quote>subsection (a)(5)</quote>.</text>
			</subsection></section><section id="HC6F81EE5845048198C34DCC6092490B3"><enum>3.</enum><header>Informational
			 calls to mobile telephone numbers</header>
			<subsection id="HC7A2820376C342E1BE2394AD7662185D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 227(b)(1)(A)
			 of the Communications Act of 1934 (47 U.S.C. 227(b)(1)(A)) is amended to read
			 as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HE709BECEC9F946EF8268DEF98CB4E76E" style="OLC">
					<subparagraph id="HEB7D02EA9A754C1E8A7F41C5ECDD29EF"><enum>(A)</enum><text display-inline="yes-display-inline">to make any call (other than a call made
				for emergency purposes or made with the prior express consent of the called
				party) using any automatic telephone dialing system or an artificial or
				prerecorded voice—</text>
						<clause id="H30AEB5D308AB4C988EBE4CFDD37DA7C6"><enum>(i)</enum><text>to
				any emergency telephone line (including any <quote>911</quote> line and any
				emergency line of a hospital, medical physician or service office, health care
				facility, poison control center, or fire protection or law enforcement
				agency);</text>
						</clause><clause id="HBB627347FD9243B1A1FF1E1B306728D9"><enum>(ii)</enum><text>to the telephone
				line of any guest room or patient room of a hospital, health care facility,
				elderly home, or similar establishment;</text>
						</clause><clause id="H3F6E0A04E3D541BD880D8158084BC449"><enum>(iii)</enum><text>to any telephone
				number assigned to a paging service; or</text>
						</clause><clause id="HDF06295257C24ED18097078D253A228C"><enum>(iv)</enum><text>to any telephone
				number assigned to a cellular telephone service, specialized mobile radio
				service, or other radio common carrier service, or any service for which the
				called party is charged for the call, unless the call is made for a commercial
				purpose that does not constitute a telephone
				solicitation;</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H798DD6D0608A485A9332C296AA188330"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 227(b)(2)(C) of the Communications Act of 1934
			 (47 U.S.C. 227(b)(2)(C)) is amended by striking <quote>paragraph
			 (1)(A)(iii)</quote> and inserting <quote>paragraph (1)(A)(iv)</quote>.</text>
			</subsection><subsection id="H30BCF3F83CB645049EE0FC963E86A8AC"><enum>(c)</enum><header>Technical
			 correction</header><text display-inline="yes-display-inline">Section 227(b)(1)
			 of the Communications Act of 1934 (47 U.S.C. 227(b)(1)) is amended by striking
			 <quote>It shall</quote> and all that follows through <quote>United
			 States—</quote> and inserting the following: <quote>It shall be unlawful for
			 any person within the United States, or any person outside the United States if
			 the recipient is within the United States—</quote>.</text>
			</subsection></section><section id="HD6D51A6626DC452AAB522C6B150065C3"><enum>4.</enum><header>Effect on State
			 law</header><text display-inline="no-display-inline">Section 227(f)(1) of the
			 Communications Act of 1934 (47 U.S.C. 227(f)(1)) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="H50C8710972E245B4BD12AF216BF45FD8" style="OLC">
				<paragraph id="H0979DC47B0C14197BE91FB00F6429A33"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">No requirement or
				prohibition may be imposed under the laws of any State with respect to any
				subject matter regulated under this section, except for telephone
				solicitations.</text>
