		<section id="H4A3F45251D3D4916AC69E5426FD6841C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Business Protection Act of
			 2012</short-title></quote>.</text>
		</section><section id="HC070D5A921CB4A14A50D53CC211769FF"><enum>2.</enum><header>Small business
			 concern size standards</header><text display-inline="no-display-inline">Section
			 3 of the Small Business Act (15 U.S.C. 632) is amended—</text>
			<paragraph id="HC48A5D5764D241159664D6F4C4C9DBC3"><enum>(1)</enum><text>by inserting after
			 the section enumerator the following: <quote><header-in-text level="section" style="OLC">Definitions</header-in-text>.</quote>; and</text>
			</paragraph><paragraph id="HFA900AFC1AA545D2BDC952CA5EEE4FD0"><enum>(2)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H823EE05911B34D6591D85B58A4F6293F"><enum>(A)</enum><text>by striking the
			 subsection enumerator and inserting the following:</text>

			 by striking <quote>(1) For the purposes</quote> and inserting the
			 following:</text>

			 by striking <quote>(3) When establishing</quote> and inserting the
			 following:</text>

				industry and consideration of other factors</header><text display-inline="yes-display-inline">When
				establishing</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="HB71FF335C49A43839AA7E83D8D12FD49"><enum>(D)</enum><text>by moving
			 paragraph (5), including each subparagraph and clause therein, 2 ems to the
			 right; and</text>
				</subparagraph><subparagraph id="H3891DD1DB4EE45FD817016666A8ABEE4"><enum>(E)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9E57323D1BA24C619DD2D86E7DC84E53" style="OLC">
						<paragraph id="HA2E2C7CBEF324F58BEB917F8B4D85812"><enum>(6)</enum><header>Common size
				standards</header><text display-inline="yes-display-inline">In carrying out
				this subsection, the Administrator may establish or approve a single size
				standard for a grouping of four digit North American Industrial Classification
				codes only if the Administrator makes publicly available, not later than the
				date on which such size standard is established or approved, a justification
				demonstrating that such size standard is appropriate for each individual
				industry classification included in the grouping.</text>
						</paragraph><paragraph commented="no" id="H694BF9EA11BC4F47A1580DC141CA43FE"><enum>(7)</enum><header>Proposed rule
				making</header><text display-inline="yes-display-inline">In conducting
				rulemaking to revise, modify or establish size standards pursuant to this
				section, the Administrator shall consider and address the following:</text>
							<subparagraph commented="no" id="H1AD9F0EA1BD247FDAAD23F9B3096DC2B"><enum>(A)</enum><text>a detailed
				description of the industry for which the new size standard is proposed;</text>
							</subparagraph><subparagraph commented="no" id="H4520DB45DE704F38BC83B0FD63F973F1"><enum>(B)</enum><text>an analysis of the
				competitive environment for that industry;</text>
							</subparagraph><subparagraph commented="no" id="H952FDDCF66C8483FAA17AAB591D8E139"><enum>(C)</enum><text>the approach the
				Administrator used to develop the proposed standard including the source of all
				data used to develop the proposed rulemaking; and</text>
							</subparagraph><subparagraph commented="no" id="H9A22B123D49248B29276E0008F9BC7D7"><enum>(D)</enum><text>the anticipated
				effect of the proposed rulemaking on the industry, including the number of
				concerns not currently considered small that would be considered small under
				the proposed rulemaking and the number of concerns currently considered small
				that would be deemed other than small under the proposed
				rulemaking.</text>
