		<section id="H80569E9E39EC4E91BDCCE95CEABEAD53" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>American Manufacturing Competitiveness
			 Act of 2012</short-title></quote>.</text>
		</section><section id="HE7CB4462173445E38203FF75ABB0AF04"><enum>2.</enum><header>National
			 manufacturing competitiveness strategy</header><text display-inline="no-display-inline">Not later than April 1, 2014 and April 1,
			 2018, the President shall submit to Congress, and publish on a public website,
			 a strategy to promote growth, sustainability, and competitiveness in the
			 Nation’s manufacturing sector, create well-paid, stable jobs, enable innovation
			 and investment, and support national security.</text>
		</section><section id="H034F6D4B0BE24C82A3EE45ADF68898FC"><enum>3.</enum><header>Manufacturing
			 competitiveness board</header>
			<subsection id="H3087516C00944B7BA47B918939F0462E"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">There is established
			 on the first day of each of the two Presidential terms following the date of
			 enactment of this Act an American Manufacturing Competitiveness Board (in this
			 Act referred to as <quote>the Board</quote>).</text>
			</subsection><subsection id="H7B42C4BDAA3349F8B3870941E86EB63F"><enum>(b)</enum><header>Members</header><text display-inline="yes-display-inline">Members of each Board shall be appointed as
			 follows:</text>
				<paragraph commented="no" id="HD767B4618BBC4E10A1829B1C02E61673"><enum>(1)</enum><header>Public Sector
			 Members</header><text>The President shall appoint to the Board—</text>
					<subparagraph id="HA83B384E885D49AABEC1AE17C6763196"><enum>(A)</enum><text>the Secretary of
			 Commerce;</text>
					</subparagraph><subparagraph id="HDC97641C2D0047C5A680768B24048A6F"><enum>(B)</enum><text display-inline="yes-display-inline">Governors of two States, from different
			 political parties, after consulting with the National Governors Association;
			 and</text>
					</subparagraph><subparagraph id="HC31FA042A805430CBAC4E747970AE51A"><enum>(C)</enum><text>two other members
			 who are current or former officials of the executive branch of
			 government.</text>
					</subparagraph></paragraph><paragraph id="H9B699C82911444C8B87948956245FE3E"><enum>(2)</enum><header>Private Sector
			 Members</header>
					<subparagraph id="HA9B0BCD2331448F5A1936F6D21055C48"><enum>(A)</enum><header>Criteria</header><text>Ten
			 individuals from the private sector shall be appointed to the Board in
			 accordance with subparagraph (B) from among individuals with experience in the
			 areas of—</text>
						<clause id="H96B3D04574594BABBD35F87208A3194A"><enum>(i)</enum><text>managing
			 manufacturing companies;</text>
						</clause><clause id="H898B4AAE434A43ABAC78EE85267A400F"><enum>(ii)</enum><text>managing supply
			 chain providers;</text>
						</clause><clause id="HD28B98BD135E4A89860AAAC11AC07523"><enum>(iii)</enum><text>managing labor
			 organizations;</text>
						</clause><clause id="H07F40B682F464CD5A2AAD53CE45B8593"><enum>(iv)</enum><text>workforce
			 development;</text>
						</clause><clause id="H425C6D6577B6490AB41CBA2E69F32B0A"><enum>(v)</enum><text>finance;</text>
						</clause><clause id="HDDC3E39EBF974268AED5BEEC22884325"><enum>(vi)</enum><text display-inline="yes-display-inline">analyzing manufacturing policy and
			 competitiveness;</text>
						</clause><clause id="H616B8AA1909A440D8602F65FD90C45F9"><enum>(vii)</enum><text>conducting
			 manufacturing-related research and development; and</text>
						</clause><clause id="HD09C2C3766124FDAA06D0505DE7CD23E"><enum>(viii)</enum><text>the defense
			 industrial base.</text>
						</clause></subparagraph><subparagraph id="H1121DE20D04B4B1F9A3EC0C5FB245630"><enum>(B)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Speaker of the House of Representatives
			 and the majority leader of the Senate shall each appoint 3 members to the
			 Board. The minority leader of the House of Representatives and the minority
			 leader of the Senate shall each appoint 2 members to the Board.</text>
					</subparagraph></paragraph></subsection><subsection id="HDC81E0F5A70E453A913F5A7CBD1EDC4E"><enum>(c)</enum><header>Termination</header><text display-inline="yes-display-inline">The Board shall terminate 60 days after
			 submitting its final report pursuant to section 4(d)(3).</text>
			</subsection><subsection commented="no" id="H88DA915539B043E9A9F19A8743F02A79"><enum>(d)</enum><header>Co-Chairmen</header><text display-inline="yes-display-inline">The Secretary of Commerce (or the designee
			 of the Secretary) and a member elected by the private sector members of the
			 Board appointed pursuant to subsection (b)(2).</text>
			</subsection><subsection id="HEB4D797D1016415E9F516A028F705FEA"><enum>(e)</enum><header>Subgroups</header><text>The
			 Board may convene subgroups to address particular industries, policy topics, or
			 other matters. Such subgroups may include members representing any of the
			 following:</text>
				<paragraph id="H52924B75AC3941AC85E9BE5722B2A699"><enum>(1)</enum><text>Other Federal
			 agencies, as the co-chairmen determine appropriate.</text>
				</paragraph><paragraph id="HB8FE8457B5DC494EA28AA721D4BB6A06"><enum>(2)</enum><text>State, local,
			 tribal, and Territorial governments.</text>
				</paragraph><paragraph id="H6505F0348BF54171ACD7D91127907D3C"><enum>(3)</enum><text>The private
			 sector, including labor, industry, academia, trade associations, and other
			 appropriate groups.</text>
				</paragraph></subsection><subsection id="HEAD32F93E752453EB13C90490A24E1BA"><enum>(f)</enum><header>Quorum</header><text>Ten
			 members of the Board shall constitute a quorum for the transaction of business
			 but a lesser number may hold hearings with the agreement of the
			 co-chairmen.</text>
			</subsection><subsection id="H88E40D9D684A4CBF9113B10E32A1FD4B"><enum>(g)</enum><header>Meetings</header>
				<paragraph id="H1A608737554543F28CC99C56B5504D8B"><enum>(1)</enum><header>Timing and
			 frequency of meetings</header><text>The Board shall meet at the call of the
			 co-chairmen, and not fewer than 2 times.</text>
				</paragraph><paragraph id="H10DD8867EBA04F1AB3E3D305C25C1061"><enum>(2)</enum><header>Public meetings
			 required</header><text>The Board shall convene public meetings to solicit views
			 on the Nation’s manufacturing sector and recommendations for the national
			 manufacturing competitiveness strategy.</text>
				</paragraph><paragraph id="H2E902651AF5F415898EC53819C11C7D8"><enum>(3)</enum><header>Locations of
			 public meetings</header><text>The locations of public meetings convened under
			 paragraph (2) shall ensure the inclusion of multiple regions and industries of
			 the manufacturing sector.</text>
				</paragraph></subsection><subsection id="H843E09FBA7E948828F50D3DD68C7F258"><enum>(h)</enum><header>Application of
			 Federal Advisory Committee Act</header><text>The Federal Advisory Committee Act
			 (5 U.S.C. App.), other than section 14 of such Act, shall apply to the Board,
			 including any subgroups established pursuant to subsection (e).</text>
			</subsection></section><section id="HEC8BD6902CDA4917A36B734EA50200DE"><enum>4.</enum><header>Duties of the
			 Board</header>
			<subsection id="HCF531F744CF0425490A9425B0B589A6A"><enum>(a)</enum><header>In
			 General</header><text>The Board shall—</text>
				<paragraph id="HF86A9ED5041846CD89C92218AD07E1C8"><enum>(1)</enum><text>advise the
			 President and Congress on issues affecting the Nation’s manufacturing
			 sector;</text>
				</paragraph><paragraph id="H30FEF49CDB484B63AC247FFC42C17027"><enum>(2)</enum><text>conduct a
			 comprehensive analysis in accordance with subsection (c); and</text>
				</paragraph><paragraph id="H2038AB9D402A40A3ACAD0A21E019B856"><enum>(3)</enum><text>develop a national
			 manufacturing competitiveness strategy in accordance with subsection
			 (d).</text>
				</paragraph></subsection><subsection id="HDE06BD182847423382588F3250A32E2A"><enum>(b)</enum><header>Preliminary
			 report</header><text display-inline="yes-display-inline">Within 180 days of a
			 quorum of each Board being nominated, the Board shall issue a preliminary
			 report on the state of American manufacturing. The preliminary report shall
			 also identify any recommendations that have been issued by the Department of
			 Commerce Manufacturing Council that have not been acted upon and a summary and
			 assessment of recommendations that have been issued by other non-governmental
			 parties relating to domestic manufacturing.</text>
			</subsection><subsection id="HE49D2DB8C0A94F56BB97262FC6C9C2CF"><enum>(c)</enum><header>Comprehensive
			 Analysis</header><text display-inline="yes-display-inline">In developing a
			 national manufacturing competitiveness strategy under subsection (d), the Board
			 shall conduct a comprehensive analysis of the Nation’s manufacturing sector,
			 taking into consideration relevant reports, plans, or recommendations issued by
			 Federal agencies, Federal advisory boards, academia, and the private sector.
			 Such analysis shall address—</text>
				<paragraph id="HBE2E0E286F954041B11AC17DD30887E5"><enum>(1)</enum><text>the value and role
			 of manufacturing in the Nation’s economy, security, and global
			 leadership;</text>
				</paragraph><paragraph id="H6FC5ECA41F8E42FEA1A77EE4DC1B0B9A"><enum>(2)</enum><text display-inline="yes-display-inline">the current domestic and international
			 environment for the Nation’s manufacturing sector, and any subsector identified
			 by the Board as warranting special study for competitiveness or for comparison
			 purposes;</text>
				</paragraph><paragraph id="H905903F9ABC8418E86A4AF2B77445F1C"><enum>(3)</enum><text>Federal, State,
			 local, and Territorial policies, programs, and conditions that affect
			 manufacturing;</text>
				</paragraph><paragraph id="H8DC0DAD1FA924DCB83EF9460CE4FEC70"><enum>(4)</enum><text display-inline="yes-display-inline">a summary of the manufacturing policies and
			 strategies of the Nation’s 10 largest trading partners, to the extent
			 known;</text>
				</paragraph><paragraph id="H3708ECC92AFC437FA30A28B13BD78866"><enum>(5)</enum><text>the identification
			 of emerging or evolving markets, technologies, and products for which the
			 Nation’s manufacturers could compete;</text>
				</paragraph><paragraph id="H04C3E6FF2D16427D8166942E3C82943C"><enum>(6)</enum><text display-inline="yes-display-inline">the identification of redundant or
			 ineffective government programs related to manufacturing;</text>
				</paragraph><paragraph id="H4D0D9B141F934862B6AC6B56692D589A"><enum>(7)</enum><text>the short- and
			 long-term forecasts for the Nation’s manufacturing sector, and forecasts of
			 expected national and international trends and factors likely to affect such
			 sector in the future;</text>
				</paragraph><paragraph id="H5B612243870346C3B4C086D3ED10C709"><enum>(8)</enum><text display-inline="yes-display-inline">the manner in which Federal agencies share
			 information and views with respect to the effects of proposed or active
			 regulations or other executive actions on the domestic manufacturing sector and
			 its workforce;</text>
				</paragraph><paragraph id="H95112DB5646D4B03B18AF664A546F124"><enum>(9)</enum><text>the
			 recommendations of the Department of Commerce Manufacturing Council, whether
			 such recommendations have been implemented, and the effect of such
			 recommendations; and</text>
				</paragraph><paragraph id="H5E37782086974D13A94184EED72F1D9D"><enum>(10)</enum><text>any other matters
			 affecting the competitiveness, growth, stability, and sustainability of the
			 Nation’s manufacturing sector relative to those of other nations,
			 including—</text>
					<subparagraph id="H2FADD3B7A6CA46288FADC3C498BF6152"><enum>(A)</enum><text>levels of domestic
			 production;</text>
					</subparagraph><subparagraph id="HCB4754962F7E46D8B682C6947B78A1D9"><enum>(B)</enum><text display-inline="yes-display-inline">productivity and the extent to which
			 national economic statistics related to manufacturing accurately measure
			 manufacturing output and productivity growth;</text>
					</subparagraph><subparagraph id="HE44B386F1BB742F1B59CCA473579E578"><enum>(C)</enum><text>trade policy and
			 balance;</text>
					</subparagraph><subparagraph id="H925FB872742A43E58BFBE54493C2C067"><enum>(D)</enum><text display-inline="yes-display-inline">energy policy;</text>
					</subparagraph><subparagraph id="HE323D946AF7B4EBF8CD935EB648B957F"><enum>(E)</enum><text>expenditures on
			 basic and applied research related to manufacturing technology;</text>
					</subparagraph><subparagraph id="H398E22195DFB4ABFB29879589B07526E"><enum>(F)</enum><text>programs to help
			 small and mid-sized manufacturers become more competitive;</text>
					</subparagraph><subparagraph id="HE4012D80A66A4954B2A27B3DD4D2724D"><enum>(G)</enum><text display-inline="yes-display-inline">the impact of Federal statutes and
			 regulations;</text>
					</subparagraph><subparagraph id="H2D42466644BF4FCEBE9465CDC7C4DECA"><enum>(H)</enum><text>the impact of
			 Federal monetary policy;</text>
					</subparagraph><subparagraph id="H9E0F010D67DE492FA10F0B6F5C9F9E5C"><enum>(I)</enum><text>the impact of
			 taxation;</text>
					</subparagraph><subparagraph id="H3501FC7FC6384B1DB818C8FBE56706DC"><enum>(J)</enum><text>financing and
			 investment;</text>
					</subparagraph><subparagraph id="HA5EA5F24CC3B4169A917D0BC3024652D"><enum>(K)</enum><text>research and
			 development;</text>
					</subparagraph><subparagraph id="H7CBA07ABE3824CBAA3FBD1CB5D84242B"><enum>(L)</enum><text>job creation and
			 employment disparities;</text>
					</subparagraph><subparagraph id="H067EEC93C49442668A5856F4ADBCB81D"><enum>(M)</enum><text>workforce skills,
			 gaps, and development;</text>
					</subparagraph><subparagraph id="H27858A7B0D354D8C861D1A6EC8690F9F"><enum>(N)</enum><text>adequacy of the
			 industrial base for maintaining national security;</text>
					</subparagraph><subparagraph id="HB827605684974173A32400EFFEB66EA6"><enum>(O)</enum><text>protections for
			 intellectual property; and</text>
					</subparagraph><subparagraph id="H676EEE59567D4C748EA12A52F7E9EFCA"><enum>(P)</enum><text>customs
			 enforcement and counterfeiting.</text>
					</subparagraph></paragraph></subsection><subsection id="H4F754451C38149698972E4714091DD6B"><enum>(d)</enum><header>National
			 Manufacturing Competitiveness Strategy</header>
				<paragraph id="HEFC3D9D5DBEB41BFB00B4B3FFB8CF90D"><enum>(1)</enum><header>Development</header><text>The
			 Board shall develop a national manufacturing competitiveness strategy, based
			 on—</text>
					<subparagraph id="H5786D7DB7FCA4307ABCE2A36AF3DEE72"><enum>(A)</enum><text>the results of the
			 comprehensive analysis conducted under subsection (c); and</text>
					</subparagraph><subparagraph id="H41C3CA726E334F899161CFF582B551FB"><enum>(B)</enum><text>any other
			 information, studies, or perspectives that the Board determines to be
			 appropriate.</text>
					</subparagraph></paragraph><paragraph id="H8B876EEC21314B2A80E8B6279081234C"><enum>(2)</enum><header>Goals and
			 recommendations</header>
					<subparagraph id="H8648B9F390CE46D08430852FDCBC4707"><enum>(A)</enum><header>Goals</header><text display-inline="yes-display-inline">The Board shall include in the national
			 manufacturing competitiveness strategy short- and long-term goals for improving
			 the competitiveness conditions of the Nation’s manufacturing sector, taking
			 into account the matters addressed in the comprehensive analysis conducted
			 under subsection (c).</text>
					</subparagraph><subparagraph id="H30A4463E387248049E84726D874C6758"><enum>(B)</enum><header>Recommendations</header><text>The
			 Board shall include in the national manufacturing competitiveness strategy
			 recommendations for achieving the goals provided under subparagraph (A). Such
			 recommendations may propose—</text>
						<clause id="H26E9608BEEAE473C97B6E84FC289A5C5"><enum>(i)</enum><text>actions to be
			 taken by the President, Congress, State, local, and territorial governments,
			 the private sector, universities, industry associations, and other
			 stakeholders;</text>
						</clause><clause id="H3279814E0952420D9A1FF219EADF4B3F"><enum>(ii)</enum><text display-inline="yes-display-inline">actions to improve government policies and
			 coordination among entities developing such policies;</text>
						</clause><clause id="H8ADCA280E38B4DBDA791A244159C6D5C"><enum>(iii)</enum><text>the
			 consolidation or elimination of government programs;</text>
						</clause><clause id="H82BD612CEFE2461C80EF86431D50453D"><enum>(iv)</enum><text>actions to
			 improve government interaction with the manufacturing sector and communication
			 regarding the effects of proposed or active government regulations or other
			 executive actions on the manufacturing sector and its workforce; and</text>
						</clause><clause id="H9B8B2A2BC8304E6AB99E2E97D75AC6FB"><enum>(v)</enum><text>the
			 elimination or repeal of regulations that place the United States manufacturing
			 sector at a disadvantage relative to other nations.</text>
						</clause></subparagraph></paragraph><paragraph id="H228C47716EBC4C72AF880A701675014E"><enum>(3)</enum><header>Report</header>
					<subparagraph id="HC6D3B95CD846455899E5CE1233D36582"><enum>(A)</enum><header>Draft</header><text>Not
			 later than 90 days before the date on which the President is required to submit
			 to Congress a report containing a national manufacturing competitiveness
			 strategy under section 2, each Board shall publish in the Federal Register and
			 on a public website a draft report containing a national manufacturing
			 competitiveness strategy.</text>
					</subparagraph><subparagraph id="HBD690D89EEC6431AAF4DBA6257F50583"><enum>(B)</enum><header>Public comment;
			 review and revision</header><text>A draft report published under subparagraph
			 (A) shall remain available for public comment for a period of not less than 30
			 days from the date of publication. The Board shall review any comments received
			 regarding such draft report and may revise the draft report based upon those
			 comments.</text>
					</subparagraph><subparagraph id="HB136E2CE141A441E967CB2F9D9C2D27F"><enum>(C)</enum><header>Publication</header><text>Not
			 later than 30 days before the date on which the President is required to submit
			 to Congress a report containing a national manufacturing competitiveness
			 strategy under section 2, each Board shall submit to the President for review
			 and revision a final report containing a national manufacturing competitiveness
			 strategy, and shall publish such final report on a public website.</text>
					</subparagraph><subparagraph id="H1E0E4E858F8949048C38D1B4D8024847"><enum>(D)</enum><header>Required
			 contents of the report</header><text>The final report submitted under
			 subparagraph (C) shall include—</text>
						<clause id="H11E728D69D6243049D50A6AAA0486DE4"><enum>(i)</enum><text>when
			 feasible, an estimate of the short- and long-term Federal Government outlays
			 and revenue changes necessary to implement the national manufacturing
			 competitiveness strategy and an estimate of savings that may be derived from
			 implementation of the national manufacturing competitiveness strategy;</text>
						</clause><clause id="H69699659C41D4A9DB18E685476875AC6"><enum>(ii)</enum><text>a
			 detailed explanation of the methods and analysis used to determine the
			 estimates included under clause (i);</text>
						</clause><clause id="H9138A14781494BBA9426B36F19187AF5"><enum>(iii)</enum><text>detailed
			 recommendations regarding how to pay for the cost of implementation estimated
			 under clause (i), when feasible; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H1F9B3D5126634913937D3484E04A38ED"><enum>(iv)</enum><text>a plan for how
			 the recommendations included in the report will be implemented and who is or
			 should be responsible for the implementation.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H336E5663469648E09EAF3CBD4C854AA2"><enum>(e)</enum><header>Consultation</header><text>In
			 order to gain perspective and avoid duplication of efforts, the Board shall
			 consult on manufacturing issues with the Defense Science Board, the President’s
			 Council of Advisors on Science and Technology, the Manufacturing Council
			 established by the Department of Commerce, and the Labor Advisory Committee for
			 Trade Negotiations and Trade Policy, and may consult with other relevant
			 governmental entities or the private sector.</text>
			</subsection></section><section id="H4B031CF423444B53BBC20BA204EC27A6"><enum>5.</enum><header>Requirement to
			 consider national manufacturing competitiveness strategy in
			 budget</header><text display-inline="no-display-inline">In preparing the budget
			 for each fiscal year through fiscal year 2020 under section 1105(a) of title
			 31, United States Code, the President shall include information regarding the
			 consistency of the budget with the goals and recommendations included in
			 national manufacturing competitiveness strategy.</text>
