        <SUBJECT>Educational Media and Descriptive Videos Loan Service Program.</SUBJECT>
        <P>The Educational Media and Descriptive Video Loan Service Program—</P>
        <P>(a) Makes educational media and descriptive videos available in the United States for nonprofit purposes to individuals with disabilities, parents of individuals with disabilities, and other individuals directly involved in activities for the advancement of individuals with disabilities; and utilizes educational media to help eliminate illiteracy among individuals with disabilities; and</P>
        <P>(b) Promotes the general welfare of visually impaired individuals by—</P>
        <P>(1) Bringing to these individuals an understanding and appreciation of textbooks, films, television programs, video material, and other educational publications and materials that play such an important part in the general and cultural advancement of visually unimpaired individuals; and</P>
        <P>(2) Ensuring access to television programming and other video materials.</P>

        <SUBJECT>Who is eligible to apply under the Educational Media and Descriptive Videos Loan Service Program?</SUBJECT>
        <P>The following are eligible to apply to borrow educational media and descriptive videos:</P>
        <P>(a) Individuals with disabilities.</P>
        <P>(b) Parents of individuals with disabilities.</P>
        <P>(c) Other persons directly involved in activities for the advancement of individuals with disabilities in the United States.</P>

        <SUBJECT>What definitions apply to the Educational Media and Descriptive Videos Loan Service Program?</SUBJECT>
        <P>(a) [Reserved]</P>
        <P>(b) The following definitions apply to the terms used in this part:</P>
        <P>
          <E T="03">Act</E> means Individuals with Disabilities Education Act.</P>
        <P>
          <E T="03">Borrower</E> means a user of loan service media.</P>
        <P>
          <E T="03">Educational media</E> means those media used for educational purposes.</P>
        <P>
          <E T="03">Films</E> means motion pictures and other materials similar in display and function, such as video tapes and video discs.</P>
        <P>
          <E T="03">Media</E> means films, filmstrips, photographs and slides, transparencies, television, audio and video tapes, audio and video discs, and similar materials. Printed materials may also be included if in combination with one or more of the preceding.</P>
        <P>
          <E T="03">Nonprofit purposes</E> means that the exhibition of media may not result in monetary gain or other tangible economic benefit to the borrower.</P>

        <SUBJECT>What are the limitations on the use of the loan service?</SUBJECT>
        <P>A borrower shall use the educational media for nonprofit purposes only. Moreover, the sum of any fees collected by the borrower for the use of the educational media may not exceed the reasonable expenses incurred by the borrower in exhibiting the media to eligible parties.</P>
