    <SECTNO>§ 300.247</SECTNO>
    <SUBJECT>Responsibilities of the LEA.</SUBJECT>
    <P>An LEA that is granted authority under § 300.245(b) to permit a public school to design, implement, and evaluate a school-based improvement plan shall—</P>
    <P>(a) Select each school under the jurisdiction of the agency that is eligible to design, implement, and evaluate the plan;</P>
    <P>(b) Require each school selected under paragraph (a) of this section, in accordance with criteria established by the LEA under paragraph (c) of this section, to establish a school-based standing panel to carry out the duties described in § 300.246(b);</P>
    <P>(c) Establish—</P>
    <P>(1) Criteria that must be used by the LEA in the selection of an eligible school under paragraph (a) of this section;</P>
    <P>(2) Criteria that must be used by a public school selected under paragraph (a) of this section in the establishment of a school-based standing panel to carry out the duties described in § 300.246(b) and that ensure that the membership of the panel reflects the diversity of the community in which the public school is located and includes, at a minimum—</P>
    <P>(i) Parents of children with disabilities who attend a public school, including parents of children with disabilities from unserved and underserved populations, as appropriate;</P>

    <P>(ii) Special education and general education teachers of public schools;<PRTPAGE P="38"/>
    </P>
    <P>(iii) Special education and general education administrators, or the designee of those administrators, of those public schools; and</P>
    <P>(iv) Related services providers who are responsible for providing services to the children with disabilities who attend those public schools; and</P>
    <P>(3) Criteria that must be used by the LEA with respect to the distribution of funds under Part B of the Act to carry out this section;</P>
    <P>(d) Disseminate the criteria established under paragraph (c) of this section to local school district personnel and local parent organizations within the jurisdiction of the LEA;</P>
    <P>(e) Require a public school that desires to design, implement, and evaluate a school-based improvement plan to submit an application at the time, in the manner and accompanied by the information, that the LEA shall reasonably require; and</P>
    <P>(f) Establish procedures for approval by the LEA of a school-based improvement plan designed under Part B of the Act.</P>
