Res. 167] The Committee on Rules, having had under consideration House Resolution 167, by a record vote of 8 to 3, report the same to the House with the recommendation that the resolution be adopted. SUMMARY OF PROVISIONS OF THE RESOLUTION The resolution provides for consideration of H.J. Res. 48, Additional Continuing Appropriations Amendments, 2011, under a closed rule. The resolution provides one hour of debate equally divided and controlled by the chair and ranking minority member of the Committee on Appropriations. The resolution waives all points of order against consideration of the joint resolution. The resolution provides that the joint resolution shall be considered as read. The resolution waives all points of order against provisions in the joint resolution. Finally, the resolution provides one motion to recommit. EXPLANATION OF WAIVERS The waiver of all points of order against consideration of the joint resolution includes a waiver of section 302(f) of the Congressional Budget Act. Although the joint resolution reduces spending by $2 billion per week over the three week life of the further continuing appropriations, the Congressional Budget Office is required by scorekeeping rules to annualize the score comparing it to the House-passed continuing resolution (H.R. 1) causing the joint resolution to be scored at a higher level, thus the joint resolution is presumed to breach the Appropriations Committee's section 302 allocations. Although the rule waives all points of order against provisions in the joint resolution, the Committee is not aware of any points of order against the joint resolution. The waiver of all points of order against provisions in the joint resolution is prophylactic in nature.
