Information Collection: Domestic Licensing of Source Material

AGENCY: Nuclear Regulatory Commission.

ACTION: Renewal of existing information collection; request for 
comment.

SUMMARY: The U.S. Nuclear Regulatory Commission (NRC) invites public 
comment on the renewal of the Office of Management and Budget (OMB) 
approval for an existing collection of information. The information 
collection is titled, ``10 CFR part 40, Domestic Licensing of Source 
Material'' (3150-0020). The NRC regulations that are the subject of 
this information collection establish procedures and criteria for the 
issuance of licenses to receive title to, receive, possess, use, 
transfer, or deliver source material. Information concerning the annual 
estimated burdens associated with the recordkeeping, reporting, and 
third party notification requirements imposed by these regulations is 
provided in the Supporting Statement for 10 CFR part 40 Domestic 
Licensing of Source Material.

DATES: Submit comments by October 26, 2015. Comments received after 
this date will be considered if it is practical to do so, but the 
Commission is able to ensure consideration only for comments received 
on or before this date.

B. Submitting Comments

    The NRC cautions you not to include identifying or contact 
information in comment submissions that you do not want to be publicly

II. Background

    In accordance with the Paperwork Reduction Act of 1995 (44 U.S.C. 
Chapter 35), the NRC is requesting public comment on its intention to 
request the OMB's approval for the information collection summarized 
below.
    1. The title of the information collection: ``10 CFR part 40, 
Domestic Licensing of Source Material.''
    2. OMB approval number: 3150-0020.
    3. Type of submission: Extension.
    4. The form number, if applicable: Not applicable.
    5. How often the collection is required or requested: On occasion. 
Reports required under Part 40 of Title 10 of the Code of Federal 
Regulations (10 CFR) are collected and evaluated on a continuing basis 
as events occur. There is a one-time submittal of information to 
receive a license. Renewal applications need to be submitted every 5 to 
10 years. Information in previous applications may be referenced 
without being resubmitted. In addition, recordkeeping must be performed 
on an on-going basis.
    6. Who will be required or asked to respond: Applicants for and 
holders of NRC licenses authorizing the receipt, possession, use, or 
transfer of radioactive source material.
    7. The estimated number of annual responses: 1,286 (368 [188 NRC 
responses + 178 recordkeepers + 2 third party responses] + 918 [200 
Agreement States responses + 717 recordkeepers + 1 third party 
response]).
    8. The estimated number of annual respondents: 160 (50 NRC 
licensees + 110 Agreement States licensees).
    9. The estimated number of hours needed annually to comply with the 
information collection requirement or request: 10,425 (5,036 NRC 
Licensees hours [2,773 reporting + 2,257 recordkeeping + 6 third party 
response] + 5,389 Agreement States licensees' hours [1,709 reporting + 
3,677 recordkeeping + 3 third party response]).
    10. Abstract: 10 CFR part 40 establishes requirements for licenses 
for the receipt, possession, use, and transfer

of radioactive source material. The application, reporting, 
recordkeeping, and third party notification requirements are necessary 
to permit the NRC to make a determination as to whether the possession, 
use, and transfer of source and byproduct material is in conformance 
with the Commission's regulations for protection of public health and 
safety.

III. Specific Requests for Comments

    The NRC is seeking comments that address the following questions:
    1. Is the proposed collection of information necessary for the NRC 
to properly perform its functions? Does the information have practical 
utility?
    2. Is the estimate of the burden of the information collection 
accurate?
    3. Is there a way to enhance the quality, utility, and clarity of 
the information to be collected?
    4. How can the burden of the information collection on respondents 
be minimized, including the use of automated collection techniques or 
other forms of information technology?
