The Department of Energy published a Notice of Inquiry on May 25, 1994, to elicit the views of affected parties on: (1) The Department's preliminary view that it does not have a statutory obligation to accept spent nuclear fuel in 1998 in the absence of an operational repository or a suitable storage facility constructed under the Nuclear Waste Policy Act of 1982, as amended; (2) the need for an interim, away-from-reactor storage facility prior to repository operations; and (3) options for offsetting, through the use of the Nuclear Waste Fund, a portion of the financial burden that may be incurred by utilities in continuing to store spent nuclear fuel at reactor sites beyond 1998 (59 FR 27007). The Notice of Inquiry implemented the Secretary's initiative to invite the views of interested parties and to advance the consensus-building process on resolving these important issues. The Notice of Inquiry requested written comments on or before September 22, 1994. In response to a request from six organizations, the Department published a Notice on October 18, 1994, announcing the reopening of this comment period until December 19, 1994 (59 FR 52524). The Department received more than 1,100 comment letters in response to the Notice of Inquiry. The purpose of this Notice is to announce the availability of the Notice of Inquiry on Waste Acceptance Issues -- Response Summary Report which the Department prepared to present a summary of the comments received in response to the Notice of Inquiry. The Department is currently reviewing the comments for the purpose of preparing its response to the issues set forth in the Notice of Inquiry.
