A BILL
To amend title 18, United States Code, to provide a criminal penalty
for dumping solid waste on certain Federal lands, to increase the fine
for illegally cutting, destroying, or transporting timber on Federal
lands, and to establish programs to decrease the illegal dumping of
solid waste on certain Federal lands.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Public Lands Protection Act of
1993''.
SEC. 2. ESTABLISHMENT OF FEDERAL CRIME FOR DUMPING SOLID WASTE ON
CERTAIN FEDERAL LANDS.
(a) In General.--Chapter 91 of title 18, United States Code, is
amended by adding at the end the following new section:
``Sec. 1865. Dumping solid waste on certain Federal lands
``(a) In General.--Whoever willfully dumps solid waste on any
Federal land shall be fined in an amount up to $5,000 or imprisoned not
more than 6 months, or both.
``(b) Definitions.--For purposes of this section, the following
definitions apply:
``(1) Federal land.--The term `Federal land' means any area
of land or water owned by the United States and administered
by--
``(A) the Bureau of Land Management;
``(B) the United States Fish and Wildlife Service;
``(C) the National Park Service;
``(D) the Bureau of Reclamation; or
``(E) the Forest Service.
``(2) Solid waste.--The term `solid waste' means--
``(A) waste generated by the normal activities of
households, including food wastes, rubbish, ashes, and
bulky wastes; and
``(B) waste generated from agricultural,
commercial, industrial, or municipal operations,
including garbage, refuse, sludges, and other discarded
solid materials.''.
(b) Conforming Amendment.--The table of sections at the beginning
of chapter 91 is amended by adding at the end the following new item:
``1865. Dumping solid waste on certain Federal lands.''.
SEC. 3. INCREASE IN FINE FOR ILLEGALLY CUTTING, DESTROYING, OR
TRANSPORTING TIMBER ON FEDERAL LANDS.
Section 1852 of title 18, United States Code, is amended--
(1) by striking ``$1,000'' and inserting ``$5,000''; and
(2) by adding at the end the following:
``Whoever violates any provision of this section shall, in addition
to any other fine imposed pursuant to this section, be fined in an
amount equal to the fair market value of the timber cut, destroyed, or
transported.''.
SEC. 4. ESTABLISHMENT OF PROGRAMS TO DECREASE ILLEGAL DUMPING OF SOLID
WASTE ON CERTAIN FEDERAL LANDS.
(a) Department of the Interior Program.--
(1) In general.--Not later than 1 year after the date of
the enactment of this Act, the Secretary of the Interior shall,
to the extent practicable, establish a program for the purpose
of decreasing the dumping of solid waste on Federal lands in
violation of section 1865 of title 18, United States Code.
(2) Federal lands defined.--For purposes of this
subsection, the term ``Federal lands'' has the meaning given
such term in section 1865 of title 18, United States Code,
except that such term does not include any area of land or
water administered by the Forest Service.
(b) Forest Service Program.--Not later than 1 year after the date
of the enactment of this Act, the Secretary of Agriculture shall, to
the extent practicable, establish a program for the purpose of
decreasing the dumping of solid waste on Federal lands administered by
the Secretary through the Forest Service in violation of section 1865
of title 18, United States Code.
(c) Conduct of Programs.--In carrying out a program established
under subsection (a) or (b), the Secretary concerned shall cooperate
with appropriate State and local agencies to disseminate information to
the public to discourage illegal dumping of solid waste on Federal
lands administered by such Secretary.
(d) Report.--Not later than 6 months after the date on which the
Secretary concerned establishes a program under subsection (a) or (b),
such Secretary shall submit to the Congress and the President a report
containing a description of--
(1) the program established by the Secretary; and
(2) the extent to which the Secretary believes the program
to be successful.
(e) Secretary Concerned Defined.--For purposes of this section, the
term ``Secretary concerned'' means--
(1) the Secretary of the Interior, with respect to the
program established by such Secretary under subsection (a); and
(2) the Secretary of Agriculture, with respect to the
program established by such Secretary under subsection (b).
(f) Effective Date.--This section shall take effect on October 1,
1993, or the date of the enactment of this Act, whichever occurs later.
