                                 A BILL


 
   To amend the Solid Waste Disposal Act to require each department, 
  agency, and instrumentality of the executive branch of the Federal 
                   Government to use recycled paper.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. REQUIREMENT FOR FEDERAL GOVERNMENT TO USE RECYCLED PAPER.

    (a) Requirement.--Subtitle F of the Solid Waste Disposal Act (42 
U.S.C. 6961 et seq.) is amended by adding at the end the following new 
section:

``SEC. 6005. REQUIREMENT FOR FEDERAL GOVERNMENT TO USE RECYCLED PAPER.

    ``(a) Requirement.--Each department, agency, and instrumentality of 
the executive branch of the Federal Government shall use printing and 
writing paper containing at least 10 percent postconsumer material.
    ``(b) Postconsumer Material Definition.--For purposes of this 
section, the term `postconsumer material' has the meaning provided by 
the Administrator in regulations implementing this section.
    ``(c) Report.--(1) Not later than January 1 of each year, the 
Administrator shall submit to Congress a report on the extent of 
compliance during the preceding fiscal year by each department, agency, 
and instrumentality of the executive branch of the Federal Government 
with the requirement of subsection (a). At a minimum, the report shall 
include--
            ``(A) an identification of each department, agency, and 
        instrumentality that failed to comply, in whole or in part, 
        with the requirement; and
            ``(B) with respect to each department, agency, and 
        instrumentality that failed to comply with the requirement, a 
        statement of the reasons for the failure to comply.
    ``(2) A copy of the annual report shall be published in the Federal 
Register.
    ``(d) Proceeds from Sale of Materials Collected from Recycling.--If 
a department, agency, or instrumentality of the executive branch of the 
Federal Government is in compliance with the requirement of subsection 
(a) during a fiscal year, as determined by the Administrator, such 
entity may use, for activities within the legal authority of such 
entity, any monies received during such fiscal year from the sale of 
materials collected for the purpose of recycling. This subsection 
applies to the Department of Defense notwithstanding section 2577 of 
title 10, United States Code.''.
    (b) Effective Date.--Section 6005 of the Solid Waste Disposal Act, 
as added by subsection (a), shall take effect one year after the date 
of the enactment of this Act.
