                                 A BILL


 
 To amend title 18, United States Code, to make certain drug offenses 
  under State law predicate offenses under the armed career criminal 
                                statute.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Armed Career Criminal Clarification 
Act''.

SEC. 2. CERTAIN DRUG OFFENSES UNDER STATE LAW MADE PREDICATE OFFENSES 
              UNDER THE ARMED CAREER CRIMINAL STATUTE.

    Section 924(e)(2)(A) of title 18, United States Code, is amended--
            (1) in clause (i), by striking ``or'' at the end;
            (2) in clause (ii), by adding ``or'' at the end; and
            (3) by adding at the end the following:
                    ``(iii) an offense under State law which, if it had 
                been prosecuted as a violation of the Controlled 
                Substances Act at the time of the offense and because 
                of the type and quantity of the controlled substance 
                involved, would have been punishable by a maximum term 
                of imprisonment of ten years or more;''.
