Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``National Science and Technology Policy, Organization, and Priorities Act Amendments of 1994''. SEC. 2. POLICY AND PRIORITIES. (a) Findings.--Section 101 of the National Science and Technology Policy, Organization, and Priorities Act of 1976 (42 U.S.C. 6601) is amended-- (1) in subsection (a)(5), by striking ``manpower'' and inserting in lieu thereof ``human resource''; and (2) in subsection (b)(1), by striking ``man and his universe'' and inserting in lieu thereof ``humans and their universe''. (b) Declaration of Policy.--Section 102 of the National Science and Technology Policy, Organization, and Priorities Act of 1976 (42 U.S.C. 6602) is amended-- (1) in subsection (a)-- (A) by redesignating paragraphs (2) through (6) as paragraphs (3) through (7), respectively; and (B) by inserting after paragraph (1) the following new paragraph: ``(2) The United States should be among the world leaders in all major areas of science, and should maintain clear leadership in selected major areas of science. The decision to select a field for clear leadership should be based on the societal goals identified under section 205(b)(2).''; (2) in subsection (b)-- (A) by redesignating paragraphs (2) through (6) as paragraphs (3) through (7), respectively; (B) by inserting after paragraph (1) the following new paragraph: ``(2) The Federal Government should cooperate with the private sector to ensure that technological leadership exists within the United States in those technologies that promise to have a major and continuing impact on the growth and future vitality of the United States economy.''; and (C) in paragraph (4), as so redesignated by subparagraph (A) of this paragraph, by striking ``It is further an appropriate Federal function to support'' and inserting in lieu thereof ``The Federal Government has a responsibility to support key''; and (3) in subsection (c)-- (A) by striking ``coordinate procedures are of paramount importance'' and inserting in lieu thereof ``steps should be taken''; and (B) in paragraph (1), by inserting ``development and'' after ``policy should encourage the''. SEC. 3. OFFICE OF SCIENCE AND TECHNOLOGY POLICY. (a) Functions.--Section 204 of the National Science and Technology Policy, Organization, and Priorities Act of 1976 (42 U.S.C. 6613) is amended to read as follows: ``functions ``Sec. 204. (a) The primary functions of the Office and the Director are to-- ``(1) recommend to the President those science and technology priorities which will best contribute to achieving the societal goals identified under section 205(b)(2); ``(2) ensure the development of a coordinated Federal research and development budget to implement the President's science and technology priorities in accordance with section 205; ``(3) provide, within the Executive Office of the President, advice on the scientific, engineering, and technological aspects of issues that require attention at the highest levels of Government; and ``(4) perform analyses of the adequacy of the science and technology base and the health of the research enterprise of the Nation. ``(b) In addition to such other functions and activities as the President may assign, the Director shall-- ``(1) advise and make policy recommendations to the President, and various components of the Executive Office of the President that formulate national policy, on scientific and technological considerations involved in areas of national concern including, but not limited to, the economy, national security, health, foreign relations and international scientific and technological cooperation, the environment, and the technological recovery and use of resources; ``(2) evaluate the scale, quality, and effectiveness of the Federal effort in science and technology and advise on appropriate actions; ``(3) assist the President in providing general leadership and coordination of the research and development programs of the Federal Government; and ``(4) cooperate with the States in carrying out responsibilities under this section. ``(c) Executive departments and agencies shall to the extent practicable provide, upon the request of the Director, such services, personnel, equipment, facilities, and information (including estimates, statistics, and technical assistance) as may be necessary for carrying out the functions of the Office, and as may be available to or procurable by such department or agency from public or private agencies and organizations and individuals, in order to avoid duplication of effort and expense. The Director may transfer funds made available pursuant to this Act to other Federal agencies as reimbursement for the utilization of such services, personnel, equipment, and facilities.''. (b) Setting Science and Technology Budget Priorities.--The National Science and Technology Policy, Organization, and Priorities Act of 1976 is amended-- (1) by striking section 206; (2) by redesignating section 205 as section 206; and (3) by inserting after section 204 the following new section: ``setting science and technology budget priorities ``Sec. 205. (a) The Director, in conjunction with the National Science and Technology Council established under title IV, shall ensure that the Federal research and development budget conforms to the President's overall science and technology priorities. In carrying out this function, the Director shall-- ``(1) at the beginning of each Executive Branch budget formulation cycle, work with the Office of Management and Budget to develop and issue guidance to the Federal departments and agencies as to the science and technology priorities to be included in the President's budget; ``(2) review department and agency budget submissions received from the Office of Management and Budget for compliance with the initial guidance on science and technology priorities provided in paragraph (1) and assist the Director of the Office of Management and Budget in developing the budget determinations provided by the Office of Management and Budget to each Federal department and agency; and ``(3) provide other assistance to the Office of Management and Budget and the departments and agencies throughout the budget development process as appropriate. The Office of Management and Budget shall work with the Director as described in paragraph (1), and shall provide to the Director, at the time of submission, the research and development budget request of each Federal department and agency to enable the Director to conduct the review described in paragraph (2). ``(b) The President, in consultation with the Director of the Office of Science and Technology Policy and the Director of the Office of Management and Budget, shall prepare an analysis of research and development in the Federal budget to accompany the budget submission to the Congress each year. The analysis shall-- ``(1) identify the President's priorities for science and technology; ``(2) identify the societal goals the priorities identified under paragraph (1) are designed to address; ``(3) present a consolidated research and development budget, identifying the funding levels for research and development in each department and agency; ``(4) identify the major categories of research and development funded by Federal departments and agencies and any multi-agency research initiatives, and identify the funding levels for each of those categories and initiatives in each participating department and agency; and ``(5) provide an explanation of any proposed changes in research and development funding from the previous fiscal year's appropriation levels, including a statement of how any proposed changes reflect the priorities identified under paragraph (1).''. (c) Policy Planning, Analysis, and Advice.--Section 206 of the National Science and Technology Policy, Organization, and Priorities Act of 1976 (42 U.S.C. 6614), as so redesignated by subsection (b)(2) of this section, is amended-- (1) by striking ``(a)'' before ``The Office shall serve''; (2) by striking subsection (b); (3) in paragraph (1), by striking ``national'' and inserting in lieu thereof ``regional, national,''; (4) in paragraph (2), by striking ``the Science and Technology Report, in accordance with section 209 of'' and inserting in lieu thereof ``reports required by''; (5) in paragraph (5), by striking ``national'' and inserting in lieu thereof ``regional, national,''; (6) in paragraph (11), by striking ``, pursuant to section 206 of this Act''; and (7) in paragraph (12), by striking ``section 102(a)(6)'' and inserting in lieu thereof ``section 102(a)(7)''. (d) Additional Functions of the Director; Administrative Provisions.--Section 207 of the National Science and Technology Policy, Organization, and Priorities Act of 1976 (42 U.S.C. 6616) is amended-- (1) by striking subsection (a); (2) by redesignating subsections (b) and (c) as subsections (a) and (b), respectively; and (3) in subsection (b), as so redesignated by paragraph (2) of this subsection-- (A) by striking ``his functions'' and inserting in lieu thereof ``functions''; (B) by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively; (C) by striking paragraph (1) and inserting in lieu thereof the following new paragraphs: ``(1) appoint and fix the compensation of such officers and employees as are necessary to perform the functions vested in the Director without regard to the provisions of title 5 of the United States Code governing appointments and compensation in the Federal service, at rates not to exceed the rate of pay for level IV of the Executive Schedule as provided pursuant to section 5315 of title 5, United States Code, and to prescribe their duties; ``(2) provide for participation of such civilian and military personnel as may be detailed to the Office as the Director may need or believe to be useful for carrying out the functions of the Director;''; (D) by striking ``and'' at the end of paragraph (3), as so redesignated by subparagraph (B) of this paragraph; (E) in paragraph (4), as so redesignated by subparagraph (B) of this paragraph-- (i) by striking ``he deems'' and inserting in lieu thereof ``are''; and (ii) by striking the period at the end and inserting in lieu thereof ``; and''; and (F) by adding at the end the following new paragraph: ``(5) accept voluntary and uncompensated services, notwithstanding the provisions of section 1342 of title 31, United States Code.''. (e) Coordination With Other Organizations.--Section 208 of the National Science and Technology Policy, Organization, and Priorities Act of 1976 (42 U.S.C. 6617) is amended-- (1) in subsection (a), by striking ``his''; (2) in subsection (a)(1), by striking ``Domestic Council, the National Security Council, the Council on Environmental Quality,'' and inserting in lieu thereof ``various components of the Executive Office of the President that formulate national policy, including the National Security Council,''; (3) in subsection (a)(2), by striking ``he deems'' and inserting in lieu thereof ``are''; (4) in subsection (a)(3), by striking ``he deems'' and inserting in lieu thereof ``are''; (5) by amending subsection (a)(4) to read as follows: ``(4) solicit the advice of the National Science Board on science and technology issues of broad national importance.''; and (6) by striking subsections (b) and (c) and inserting in lieu thereof the following: ``(b) The Director shall make scientific and technological cooperation with the States a priority. The Director shall-- ``(1) on matters affecting the States, ensure the representation of the States in Federal policy development and encourage State representation on key policy bodies and program initiatives; and ``(2) periodically convene meetings with State government representatives and Federal and other leaders to assess the effectiveness of Federal-State cooperation.''. SEC. 4. PRESIDENT'S COMMITTEE OF ADVISORS ON SCIENCE AND TECHNOLOGY. Title III of the National Science and Technology Policy, Organization, and Priorities Act of 1976 (42 U.S.C. 6631 et seq.) is amended to read as follows: ``TITLE III--PRESIDENT'S COMMITTEE OF ADVISORS ON SCIENCE AND TECHNOLOGY ``establishment ``Sec. 301. (a) The President shall establish within the Executive Office of the President the President's Committee of Advisors on Science and Technology (hereinafter referred to as the `Committee of Advisors'). ``(b) The President shall appoint members of the Committee of Advisors not later than 90 days after the date of enactment of the National Science and Technology Policy, Organization, and Priorities Act Amendments of 1994. ``membership ``Sec. 302. The Committee of Advisors shall consist of-- ``(1) the Director of the Office of Science and Technology Policy, or another official of the Executive Office of the President, to be designated by the President, who performs similar functions; ``(2) not more than 14 other members appointed by the President, for such periods as the President may determine; and ``(3) one member of the National Science Board, who shall be selected by the President from among the members of that Board. ``qualifications ``Sec. 303. (a) Members of the Committee of Advisors appointed by the President pursuant to section 302(2) shall-- ``(1) be eminent in one or more areas of science, engineering, technology, information dissemination, education, or public affairs; ``(2) be acknowledged experts in their respective fields of expertise and be selected solely on the basis of established records of distinguished service; ``(3) collectively constitute a balanced composition with respect to-- ``(A) fields of science, engineering, and technology; and ``(B) academic, industrial, and government experience; and ``(4) be so selected as to provide the views of scientific and engineering leaders in all regions of the Nation. ``(b) In making nominations under this section, the President shall give due regard to equitable representation of scientists and engineers who are women or members of minority groups. ``(c) The member described in section 302(1) shall chair the Committee of Advisors and a non-Federal sector member selected by the Committee of Advisors shall serve as Vice Chair. ``duties and functions ``Sec. 304. The Committee of Advisors shall-- ``(1) upon request, critically assess and provide advice and recommendations to the President on science and technology policies, priorities, programs, and issues confronting the Nation; ``(2) assist the National Science and Technology Council in securing private sector involvement in the development of advice and recommendations on science and technology policies, priorities, programs, and issues confronting the Nation; and ``(3) perform other duties as requested by the President. ``administration ``Sec. 305. (a) The Office of Science and Technology Policy shall provide such administrative services to the Committee of Advisors as may be required. ``(b) The heads of Federal departments and agencies shall, to the extent permitted by law, provide the Committee of Advisors such information with respect to scientific and technological matters as is required for the purpose of carrying out its functions. ``(c) Section 14 of the Federal Advisory Committee Act shall not apply to the Committee of Advisors.''. SEC. 5. NATIONAL SCIENCE AND TECHNOLOGY COUNCIL. (a) In General.--Title IV of the National Science and Technology Policy, Organization, and Priorities Act of 1976 (42 U.S.C. 6651 et seq.) is amended to read as follows: ``TITLE IV--NATIONAL SCIENCE AND TECHNOLOGY COUNCIL ``establishment ``Sec. 401. There is established in the Executive Office of the President the National Science and Technology Council (hereinafter referred to as the `Council'). ``membership ``Sec. 402. The Council shall be composed of-- ``(1) the President, who shall serve as Chair; ``(2) the Vice-President; ``(3) the Director of the Office of Science and Technology Policy, or another official of the Executive Office of the President, to be designated by the President, who performs similar functions; ``(4) the Secretary of Agriculture; ``(5) the Secretary of Commerce; ``(6) the Secretary of Defense; ``(7) the Secretary of Education; ``(8) the Secretary of Energy; ``(9) the Secretary of Health and Human Services; ``(10) the Secretary of the Interior; ``(11) the Secretary of State; ``(12) the Administrator of the National Aeronautics and Space Administration; ``(13) the Director of the National Science Foundation; ``(14) the Director of the National Institutes of Health; ``(15) the Administrator of the Environmental Protection Agency; ``(16) the Chair of the Council of Economic Advisers; ``(17) the Director of the Office of Management and Budget; ``(18) the National Security Adviser; and ``(19) such other officials of executive departments and agencies as the President may, from time to time, designate. ``meetings ``Sec. 403. The President, or upon his direction, the member described in section 402(3), may convene meetings of the Council. The President shall preside over the meetings of the Council, except that in his absence the Vice President and in his absence the member described in section 402(3), shall preside. ``duties and functions ``Sec. 404. (a) The Council shall consider problems and developments in the fields of science, engineering, and technology, and related activities affecting more than one Federal agency, and shall develop policies and other measures designed to-- ``(1) provide more effective planning and administration of Federal scientific, engineering, and technological programs; ``(2) ensure that science and technology policy decisions and programs are consistent with the President's stated goals; ``(3) ensure the adequacy of and achieve effective utilization of the scientific, engineering, and technological resources and facilities of Federal agencies, including the elimination of unwarranted duplication; and ``(4) further international cooperation in science, engineering, and technology. ``(b) The Council shall assume the responsibilities and authorities of the National Critical Materials Council and the Federal Coordinating Council for Science, Engineering, and Technology. The Council shall coordinate as necessary with the National Security Council in carrying out the former responsibilities of the National Critical Materials Council. ``(c) The Council shall perform such other related duties as shall be assigned by the President. ``(d) In exercising its duties and functions the Council-- ``(1) shall work closely with the heads of all relevant Federal departments and agencies; ``(2) may utilize consultants and representatives of industry, academia, and State and local governments; ``(3) shall hold hearings in various parts of the Nation as necessary; and ``(4) shall avoid duplication of effort and expense. ``research and development budget coordination ``Sec. 405. (a) In coordinating science and technology policy, including research and development budget requests, the Council shall-- ``(1) appraise progress in science and technology in relation to the societal goals identified under section 205(b)(2), and determine the desired level of Federal investment in science and technology; ``(2) identify priorities for allocating Federal funds among expenditure areas in science and technology in order to address the societal goals identified under section 205(b)(2), including the selection of multi-agency research and development initiatives; ``(3) consider the ways in which scientific and technical knowledge and principles can be applied to achieving the societal goals identified under section 205(b)(2); and ``(4) ensure the coordination of Federal science and technology programs and eliminate unnecessary duplication of effort among these programs. ``(b) Executive departments and agencies shall to the extent practicable make resources, including personnel, office support, and printing, available to the Council. Such assistance may include-- ``(1) detailing employees to the Council to perform such functions, consistent with the purposes of this title, as the President may assign to them; and ``(2) undertaking, upon request of the President, special studies. ``interagency working groups ``Sec. 406. (a) The Council is authorized to establish, for the purpose of conducting studies and making reports as directed by the President, Interagency Working Groups of the Council, and shall designate the subject areas and membership of the Interagency Working Groups and oversee their work. ``(b) The Interagency Working Groups shall assist the Council in carrying out its duties and functions by-- ``(1) developing detailed plans, including funding requirements for multi-agency research and development initiatives, and serve as a forum for coordinating agency activities in implementing such initiatives; ``(2) defining a coherent approach for applying science and technology to specific emerging national problems; ``(3) gathering timely and authoritative information on developments in science and technology to determine how such developments are affecting the achievement of the policy set forth in section 102 of this Act; ``(4) initiating studies to determine which of the scientific and technological alternatives available will best contribute to achieving the societal goals identified under section 205(b)(2); ``(5) reviewing and appraising various science and technology related activities of the Federal Government to determine the extent to which such activities are contributing to the achievement of the societal goals identified under section 205(b)(2), and make recommendations to the President as appropriate; and ``(6) performing other duties as requested by the President or the Council.''. (b) Repeals.--Sections 202(b), 203, 207, 208, 209, 210, and 211 of the National Critical Materials Act of 1984 are repealed. SEC. 6. NATIONAL SCIENCES AND TECHNOLOGIES ASSESSMENT PANEL. (a) Establishment.--Section 601 of the National Science and Technology Policy, Organization, and Priorities Act of 1976 (42 U.S.C. 6681) is amended to read as follows: ``establishment ``Sec. 601. The Director of the Office of Science and Technology Policy shall establish within that office a National Sciences and Technologies Assessment Panel (hereafter in this title referred to as the `panel'). The panel shall prepare the biennial national critical technologies report required under section 603, and the annual assessment required under section 604.''. (b) Membership.--Section 602 of the National Science and Technology Policy, Organization, and Priorities Act of 1976 (42 U.S.C. 6682) is amended-- (1) in subsection (a), by striking ``13 members'' and inserting in lieu thereof ``the Director of the Office of Science and Technology Policy, who shall serve as Chairman, and 14 other''; (2) in subsection (a)(1), by striking ``nine members'' and all that follows through ``shall be appointed'' and insert in lieu thereof ``8 members''; (3) by adding at the end of subsection (a) the following new paragraphs: ``(6) The Secretary of Health and Human Services shall appoint one member, who shall be an official of the National Institutes of Health. ``(7) The Director of the National Science Foundation shall appoint one member, who shall be an official of that agency.''; (4) in subsection (b)(1), by striking ``(a)(1)(B)'' and inserting in lieu thereof ``(a)(1)''; and (5) by striking subsection (c). (c) National Performance Assessments for Research.--The National Science and Technology Policy, Organization, and Priorities Act of 1976 is amended-- (1) by striking section 605; (2) by redesignating section 604 as section 605; and (3) by inserting after section 603 the following new section: ``national performance assessments for research ``Sec. 604. (a) The panel shall submit to the President an annual report on the Nation's performance in selected major fields of research, incorporating the results of consultation described in subsection (d). ``(b) Each such report shall include, with respect to each selected major field of research-- ``(1) a review of the relative performance of the United States as compared to that of other nations; ``(2) an estimate of the trend in relative performance during the next five years; ``(3) an assessment of the contribution of Federal research and development programs to the progress made in that field of research; ``(4) the factors that are likely to affect the Nation's performance in the next five years, with particular attention to those factors that may adversely affect relative performance; and ``(5) recommendations for any Federal policy changes necessary to improve the Nation's research performance, and a review of the implementation of any recommendations made in previous reports under this paragraph. ``(c) Each major field of research shall be treated in an annual assessment report at least once in each five year period. ``(d) In preparing the report the panel shall consult extensively with appropriate public and private organizations and individuals capable of providing independent and knowledgeable assessments. Such organizations and individuals shall include researchers in the subject field who reside in the United States and in other nations, researchers in related fields, and those who apply research to solve practical problems. ``(e) Not later than 30 days after the date on which a report is submitted to the President under this section, the President shall transmit the report, together with any comments that the President considers appropriate, to Congress.''. (d) Administration and Funding of the Panel.--Section 605 of the National Science and Technology Policy, Organization, and Priorities Act of 1976 (42 U.S.C. 6684) as so redesignated by subsection (c)(2) of this section, is amended by striking ``Funds for'' and all that follows through ``for that Office.''. SEC. 7. SCIENCE AND TECHNOLOGY POLICY INSTITUTE. (a) In General.--The National Science and Technology Policy, Organization, and Priorities Act of 1976 is amended by adding at the end the following new title: ``TITLE VII--SCIENCE AND TECHNOLOGY POLICY INSTITUTE ``establishment ``Sec. 701. There shall be established a federally funded research and development center to be known as the Science and Technology Policy Institute (hereafter in this title referred to as the `Institute'). The Critical Technologies Institute, the authority for which is repealed by section 7(b) of the National Science and Technology Policy, Organization, and Priorities Act Amendments of 1994, may be used as a basis for the establishment of the Institute. ``operating committee ``Sec. 702. (a) The Institute shall have an Operating Committee, which shall provide oversight for the Institute, composed of 6 members as follows: ``(1) The Director of the Office of Science and Technology Policy, who shall be Chair of the Operating Committee. ``(2) The Director of the National Institutes of Health. ``(3) The Director of the Advanced Research Projects Agency. ``(4) The Under Secretary of Commerce for Technology. ``(5) The Director of the National Science Foundation. ``(6) The Under Secretary of Energy having responsibility for science and technology matters. ``(b) The Operating Committee shall meet not less than four times a year. ``functions ``Sec. 703. The functions of the Institute shall include the following: ``(1) Provision, upon the request of the Director of the Office of Science and Technology Policy, of technical support and assistance to the National Science and Technology Council and its Interagency Working Groups. ``(2) Initiation of studies and analyses with the approval of the Director of the Office of Science and Technology Policy (including science and technology assessments and systems analyses) of alternatives available for ensuring long-term leadership by the United States in the research, development, production capability, and application of the technologies identified in the most recent biennial report submitted to Congress by the President pursuant to section 603 of this Act, including appropriate strategies and roles for the Federal Government, State governments, private industry, and institutions of higher education. ``(3) The assembly of timely and authoritative information regarding significant developments and trends in science and technology in the United States and abroad, with particular emphasis on information relating to the fields of science and the technologies identified in the most recent biennial report submitted to Congress by the President pursuant to section 603 of this Act. ``(4) Analysis and interpretation of the information referred to in paragraph (3) to determine whether such developments and trends are likely to affect United States science and technology policies. ``consultation on institute activities ``Sec. 704. In carrying out the functions referred to in section 703, personnel of the Institute shall-- ``(1) consult widely with representatives from private industry, institutions of higher education, nonprofit institutions, and Federal and State agencies; and ``(2) to the maximum extent practicable, incorporate information and perspectives derived from such consultations in carrying out such functions. ``sponsorship ``Sec. 705. The Director of the National Science Foundation, in consultation with the Chair of the Operating Committee, shall enter into a sponsoring agreement with respect to the Institute. The sponsoring agreement shall require that the Institute carry out the functions specified in section 703 and such functions as the Operating Committee may specify, consistent with section 703. The sponsoring agreement shall be consistent with the general requirements prescribed for such a sponsoring agreement by the Administrator for Federal Procurement Policy. Beginning in fiscal year 1996, and in each fiscal year thereafter, only funds appropriated to the Office of Science and Technology Policy may be used to fund the sponsoring agreement.''. (b) Repeal.--Section 822 of the National Defense Authorization Act for Fiscal Year 1991 (42 U.S.C. 6686), and the table of contents relating thereto, are repealed. SEC. 8. REPORT TO CONGRESS. The Director of the Office of Science and Technology Policy shall transmit to the Congress, at the time of the President's budget request for fiscal year 1996 and annually thereafter, a report providing for the most recently ended fiscal year-- (1) a listing, for each individual detailed to the Office of Science and Technology Policy or the National Science and Technology Council from other Federal agencies, the pay grade and position of such individual at the agency from which it is detailed and the pay grade and position of such individual at the Office of Science and Technology Policy or the National Science and Technology Council; (2) the number of non-Federal personnel working for the Office of Science and Technology Policy or the National Science and Technology Council, and the names of the organizations sponsoring such personnel; and (3) a listing of the amounts contributed, in cash or in kind, by all Federal agencies to the operation of the Office of Science and Technology Policy or the National Science and Technology Council, other than amounts described in paragraph (1). SEC. 9. SECURITY ACCESS. No permanent employee or detailee at the Office of Science and Technology Policy who has failed to provide, within 30 days after beginning such employment or detail, all information required for obtaining an Executive Office of the President Access Pass or other appropriate security clearance may be permitted access to the offices of the Executive Office of the President until such information is provided.
