Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``Correction Officer Protection Act of 1993''. SEC. 2. TITLE 18 AMENDMENT. (a) In General.--Chapter 51 (relating to homicide) of title 18, United States Code, is amended by adding at the end the following: ``Sec. 1118. Murder of State and local correctional officers by prisoners ``(a) Whoever, being incarcerated pursuant to a conviction for crime, kills an individual who is a State or local correctional officer-- ``(1) while such individual is engaged in carrying out official duties as such officer; ``(2) because of the nature of the official duties of such officer; or ``(3) because of such individual's being such an officer; shall be subject to the penalty of death, if the killing is a first degree murder, and subject to the penalties provided in sections 1111 and 1112 of this title in any other case. ``(b) As used in this section-- ``(1) the term `State or local correctional officer' means any person who is a State or local officer or employee, as such term is defined in section 1501 of title 5, and who in the course of official duty performs corrections-related or law enforcement functions; and ``(2) the term `State or local government' includes the District of Columbia, Puerto Rico, and any other territory and possession of the United States. ``(c) The procedures applicable to a penalty of death under section 902(i) of the Federal Aviation Act of 1958 (49 U.S.C. App. 1472(i)) shall also be applicable, as nearly as practicable, to a penalty of death under this section.''. (b) Clerical Amendment.--The table of sections at the beginning of chapter 51 of title 18, United States Code, is amended by adding at the end the following: ``1118. Murder of State and local correctional officers by prisoners.''. <all>
