                                H. R. 5132

 To establish a period during which individuals under 65 years of age 
 who are entitled to benefits under part A of the medicare program on 
 the basis of a disability or end stage renal disease may enroll under 
      part B of the medicare program in order to meet eligibility 
requirements for health benefits under the Civilian Health and Medical 
 Program of the Uniformed Services under title 10, United States Code.

 To establish a period during which individuals under 65 years of age 
 who are entitled to benefits under part A of the medicare program on 
 the basis of a disability or end stage renal disease may enroll under 
      part B of the medicare program in order to meet eligibility 
requirements for health benefits under the Civilian Health and Medical 
 Program of the Uniformed Services under title 10, United States Code.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. ESTABLISHMENT OF OPEN ENROLLMENT PERIOD UNDER MEDICARE PART 
              B FOR CERTAIN MEDICARE BENEFICIARIES ELIGIBLE FOR 
              BENEFITS UNDER CHAMPUS.

    (a) In General.--For purposes of section 1837 of the Social 
Security Act, the Secretary of Health and Human Services shall 
establish an open enrollment period for the first 4 months of 1995 
during which an individual described in section 2 may enroll in the 
supplementary medical insurance program established under part B of 
title XVIII of such Act.
    (b) Waiver of Penalty for Late Enrollment.--For purposes of section 
1839(b) of the Social Security Act, an individual described in section 
2 who enrolls in part B of the medicare program during the open 
enrollment period described in subsection (a) shall be considered to 
have enrolled in part B of such program during the individual's initial 
enrollment period under section 1837 of such Act.

SEC. 2. INDIVIDUALS ELIGIBLE TO ENROLL DESCRIBED.

    An individual described in this section is an individual who would 
be described in section 1086(d)(2) of title 10, United States Code, if 
the individual were enrolled in the supplementary medical insurance 
program under part B of title XVIII of the Social Security Act.
