                                 A BILL


 
 To establish a 2-year moratorium on construction and leasing of space 
           by the Federal Government, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Federal Building Moratorium Act of 
1993''.

SEC. 2. DEFINITION OF FEDERAL AGENCY.

    As used in this Act, the term ``Federal agency'' includes--
            (1) any Executive Agency (as defined in section 105 of 
        title 5, United States Code);
            (2) any Executive department (as described in section 101 
        of such title);
            (3) any Government corporation (as defined in section 103 
        of such title);
            (4) the Executive Office of the President;
            (5) any independent establishment (as defined in section 
        104 of such title);
            (6) any court of the United States;
            (7) any military department of the United States;
            (8) the Senate and the House of Representatives; and
            (9) any other division of the Federal Government.

SEC. 2. MORATORIUM.

    (a) In General.--Subject to the other provisions of this section, 
during the 2-year period beginning on the date of enactment of this 
Act--
            (1) no Federal agency shall enter into a contract for the 
        construction of a new building or the lease of a building or 
        part of a building; and
            (2) no funds shall be appropriated for a contract for the 
        construction of a new building or the lease of a building or a 
        part of a building by a Federal agency.
    (b) Pending Projects.--The limitation imposed in subsection (a) 
shall not apply to--
            (1) a contract for the construction or lease of a building 
        entered into before the date of enactment of this Act without 
        regard to whether the construction or lease term has commenced;
            (2) a lease that, by its terms--
                    (A) is scheduled to expire not later than 2 years 
                after the date of enactment of this Act; and
                    (B) has an option for renewal upon expiration;
            (3) a contract for the construction of an addition to a 
        Federal building in existence on the date of enactment of this 
        Act; or
            (4) a contract for the rehabilitation of a Federal building 
        in existence on the date of enactment of this Act.
    (c) Waiver.--The President may waive the requirements of this 
section if the President determines that the construction or lease of a 
building by a Federal agency is necessary--
            (1) to ensure national security;
            (2) to promote an essential national priority; or
            (3) to respond to a national emergency.
    (d) Exception.--
            (1) In general.--This section shall not apply to the 
        construction of a building primarily used for education.
            (2) Limitation.--This subsection shall not apply to a 
        building used primarily for administrative or other 
        nonteaching-related aspects of education.
