Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. AUTHORIZATION OF PAYMENT. Notwithstanding the sovereign immunity of the United States, any statute of limitations, lapse of time, bar of laches, res judicata, collateral estoppel, or any other procedural defense, or any other provision of law, the Secretary of the Treasury shall pay to the Pottawatomi Nation in Canada, out of any money in the Treasury of the United States not otherwise appropriated, $________, which shall be equal to the sum of-- (1) the proportionate share of the tribal funds and annuities that arise under treaties between the Pottawatomi Nation and the United States that, but for the residence of the Pottawatomi Nation in Canada and outside of the territorial limits of the United States, would have been compensable under the Indian Claims Commission Act (25 U.S.C. 70 et seq.); plus (2) interest computed at a rate of 5 percent per year on the amounts calculated under paragraph (1). SEC. 2. ATTORNEY FEES. (a) In General.--Not more than 10 percent of the amount paid to the Pottawatomi Nation in Canada pursuant to section 1 may be used to pay attorney fees arising from services rendered in connection with claims of the Pottawatomi Nation in Canada relating to the compensation authorized under such section. (b) Penalties.--Any person licensed to practice law in the United States who knowingly receives a payment in violation of subsection (a) shall, upon conviction, be guilty of an infraction under section 3559(a)(9) of title 18, United States Code, and shall be subject to a fine in an amount not to exceed $1,000. <all>
