Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``National Transportation Safety Board Amendments Act of 2006''. SEC. 2. AUTHORIZATION OF APPROPRIATIONS. (a) In General.--Section 1118(a) of title 49, United States Code, is amended to read as follows: ``(a) In General.--There is authorized to be appropriated for the purposes of this chapter $81,594,000 for fiscal year 2007, $99,974,000 for fiscal year 2008, and $104,844,000 for fiscal year 2009. Such sums shall remain available until expended.''. (b) Emergency Fund.-- (1) In general.--Section 1118(b) of such title is amended to read as follows: ``(b) Emergency Fund.-- ``(1) In general.--The Board has an emergency fund available for necessary expenses of the Board, not otherwise provided for, for accident investigations. ``(2) Authorization of appropriations.--There is authorized to be appropriated such sums as may be necessary to maintain the fund at a level not to exceed $4,000,000. ``(3) Availability of amounts.--Amounts in the fund shall be available without further appropriations action and shall remain available until expended.''. (2) Funding.--There is appropriated $2,002,000 to the emergency fund authorized by section 1118(b) of title 49, United States Code. (c) Fees, Refunds, and Reimbursements.--Section 1118(c) of such title is amended-- (1) in the subsection heading by striking ``Academy'' and inserting ``Fees, Refunds, and Reimbursements''; (2) by striking paragraphs (1) and (2) and inserting the following: ``(1) In general.--The Board may collect such fees, refunds, and reimbursements, as the Board determines appropriate for services provided by or through the Board.''; (3) by redesignating paragraphs (3) and (4) as paragraphs (2) and (3), respectively; and (4) in paragraph (2) (as so redesignated)-- (A) in the matter preceding subparagraph (A) by inserting ``, refund, or reimbursement'' after ``fee''; and (B) in each of subparagraphs (A) and (B) by inserting before the semicolon at the end the following: ``or with which the refund or reimbursement is associated''. (d) Report on Academy Operations.--Section 1118 of such title is amended by striking subsection (d). SEC. 3. STAFF OF NTSB MEMBERS. Section 1111(e)(1) of title 49, United States Code, is amended by inserting before the semicolon at the end the following: ``, except that each member of the Board shall appoint employees on the member's personal staff''. SEC. 4. TECHNICAL CORRECTIONS. (a) Functional Unit for Marine Investigations.--Section 1111(g) of title 49, United States Code, is amended by adding at the end the following: ``(5) marine.''. (b) Airport and Airway Financing.--Chapter 481 of such title is amended-- (1) in section 48103(3) by striking ``$3,600,000,000'' and inserting ``$3,514,500,000''; and (2) in section 48104 is amended by striking ``the balance'' and inserting ``The balance''. SEC. 5. ANNUAL REPORT. Section 1117 of title 49, United States Code, is amended-- (1) by striking ``and'' at the end of paragraph (2); (2) by striking the period at the end of paragraph (3) and inserting ``; and''; and (3) by adding at the end the following: ``(4) a description of the activities and operations of the National Transportation Safety Board Academy.''. SEC. 6. MARINE CASUALTY INVESTIGATIONS. Section 1131(a)(1)(E) of title 49, United States Code, is amended-- (1) by striking ``on the navigable waters or territorial sea of the United States,'' and inserting ``on or under waters subject to the jurisdiction of the United States,''; and (2) by inserting ``(as defined in section 2101(46) of title 46)'' after ``vessel of the United States''. SEC. 7. PAYMENT FOR SERVICES OF INSPECTOR GENERAL. Effective October 1, 2006, section 1137 of title 49, United States Code, is amended by striking subsection (d). SEC. 8. INVESTIGATION SERVICES. (a) In General.--Section 4(a) of the National Transportation Safety Board Reauthorization Act of 2003 (Public Law 108-168; 49 U.S.C. 1113 note) is amended by striking ``From the date of enactment of this Act through September 30, 2006, the'' and inserting ``The''. (b) Report.--Section 4(b) of such Act is amended by striking ``On February 1, 2006,'' and inserting ``On July 1 of each year, as part of the annual report required by section 1117 of title 49, United States Code,''. SEC. 9. RESCISSION OF UNOBLIGATED BALANCES. There is rescinded $2,002,000 of the unobligated balances of funds made available under section 101(a)(2) of the Air Transportation Safety and System Stabilization Act (Public Law 107-42; 49 U.S.C. 40101 note). SEC. 10. REVIEW OF ALASKA RUNWAY SAFETY AREA PROJECT. (a) Safety Area Alternatives.--With regard to an environmental review of a project to improve runway safety areas on Runway 8/26 at Juneau International Airport, the Secretary of Transportation may only select as the preferred alternative the least expensive runway safety area alternative that meets the standards of the Federal Aviation Administration and that maintains the length of the runway as of the date of enactment of this Act. (b) Costs to Be Considered.--In determining what is the least expensive runway safety area for purposes of subsection (a), the Secretary shall consider, at a minimum, the initial development costs and life cycle costs of the project. (c) Satisfaction of Requirement.--With respect to the project described in subsection (a), the requirements of section 303(c)(1) of title 49, United States Code, shall be considered to be satisfied by the selection of the least expensive safety area alternative.
