 <section id="H6D0BF6F1F31F4295B96CA20DA3578EC1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hydropower Policy Modernization Act of 2017</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="H73DBCB9DB23647EE9D2CC0C24C87767F" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Hydropower regulatory improvements</header> <subsection commented="no" display-inline="no-display-inline" id="HC618EEDDF73A4659B6BFDBE39A353E29"><enum>(a)</enum><header display-inline="yes-display-inline">Sense of Congress on the use of hydropower renewable resources</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HBEE6873194614FEC9A6747FC256ECF60"><enum>(1)</enum><text display-inline="yes-display-inline">hydropower is a renewable resource for purposes of all Federal programs and is an essential source of energy in the United States; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H86DAE1B7399F4C8F95DB39EAD065802E"><enum>(2)</enum><text display-inline="yes-display-inline">the United States should increase substantially the capacity and generation of clean, renewable hydropower that would improve environmental quality in the United States.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEB219102DE8D4360993F648AB9FEC793"><enum>(b)</enum><header display-inline="yes-display-inline">Modifying the definition of renewable energy to include hydropower</header><text display-inline="yes-display-inline">Section 203 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15852">42 U.S.C. 15852</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H1FF808B5B9D44E5EAA06F2ED93472772"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>the following amounts</quote> and all that follows through paragraph (3) and inserting <quote>not less than 15 percent in fiscal year 2017 and each fiscal year thereafter shall be renewable energy.</quote> ; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8D835FE3B9B44FC485307E6D0807D6F4"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking paragraph (2) and inserting the following:</text> <quoted-block changed="added" committee-id="HIF00" display-inline="no-display-inline" id="HF218A82E4155445C904D3A78520937F1" reported-display-style="italic" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="HAAF3E6F1EB27454DA34D8D2A8A95C2D3"><enum>(2)</enum><header display-inline="yes-display-inline">Renewable energy</header><text display-inline="yes-display-inline">The term <term>renewable energy</term> means electric energy generated from solar, wind, biomass, landfill gas, ocean (including tidal, wave, current, and thermal), geothermal, or municipal solid waste, or from a hydropower project.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAA72D6CC52C54795AE76E26FF2DB2A1A"><enum>(c)</enum><header display-inline="yes-display-inline">Preliminary permits</header><text display-inline="yes-display-inline">Section 5 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/798">16 U.S.C. 798</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H95D3DE3ADC9C44EA9015A013DCBF5E3B"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>three</quote> and inserting <quote>4</quote>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2F22C86FE4444573AF95FB616B6636C8"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subsection (b) to read as follows:</text> <quoted-block changed="added" committee-id="HIF00" display-inline="no-display-inline" id="H4A59FDC0A70245C9948F76289B7A3FB6" reported-display-style="italic" style="OLC"> <subsection commented="no" id="H310A0AD1D37349368ADF0697DB94086E"><enum>(b)</enum><text display-inline="yes-display-inline">The Commission may—</text>
 <paragraph commented="no" id="H5BCF143AC3FE40EE8380D52E065158BD"><enum>(1)</enum><text>extend the period of a preliminary permit once for not more than 4 additional years beyond the 4 years permitted by subsection (a) if the Commission finds that the permittee has carried out activities under such permit in good faith and with reasonable diligence; and</text>
 </paragraph><paragraph commented="no" id="H761338E908DD4D689B307DBAFBFAA86B"><enum>(2)</enum><text>if the period of a preliminary permit is extended under paragraph (1), extend the period of such preliminary permit once for not more than 4 additional years beyond the extension period granted under paragraph (1), if the Commission determines that there are extraordinary circumstances that warrant such additional extension.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8C39F3B2D0334B09A709C70B4118679D"><enum>(d)</enum><header display-inline="yes-display-inline">Time limit for construction of project works</header><text display-inline="yes-display-inline">Section 13 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/806">16 U.S.C. 806</external-xref>) is amended in the second sentence by striking <quote>once but not longer than two additional years</quote> and inserting <quote>for not more than 8 additional years,</quote>.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="H943D528EBC8D4119BEFE396274597B30"><enum>(e)</enum><header display-inline="yes-display-inline">License term</header><text display-inline="yes-display-inline">Section 15(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/808">16 U.S.C. 808(e)</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H1D3FA0A1DA3148E49BD890EA6DBED453"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(e) Except</quote> and inserting the following:</text> <quoted-block changed="added" committee-id="HIF00" display-inline="no-display-inline" id="HD5FBAC7F46184E289A24433F168FD2B7" reported-display-style="italic" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="HC70EF2BE7BB942EAB990963400E10351"><enum>(e)</enum><header display-inline="yes-display-inline">License term on relicensing</header> <paragraph commented="no" display-inline="no-display-inline" id="HB86DAC507F8A4AAEB178E56ED23C4978"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H521CBC3940E8496C85856AB204FC3C7E"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block changed="added" committee-id="HIF00" display-inline="no-display-inline" id="HD6AAFDEF8DC94BDCBA69C07BC0166B43" reported-display-style="italic" style="OLC"> <paragraph commented="no" id="HE3783151344146EE84CE07C2A0DFFFAC"><enum>(2)</enum><header>Consideration</header><text display-inline="yes-display-inline">In determining the term of a license under paragraph (1), the Commission shall consider, among other things, project-related investments to be made by the licensee under a new license issued under this section, as well as project-related investments made by a licencee over the term of the existing license (including any terms under annual licenses). In considering such investments, the Commission shall give the same weight to—</text>
 <subparagraph commented="no" id="HDD5178F446A64BF79115A15C1C95ED10"><enum>(A)</enum><text display-inline="yes-display-inline">investments to be made by the licensee to implement a new license issued under this section, including—</text>
 <clause commented="no" id="H73138FC08E0C43DF854B37C1D2A4B199"><enum>(i)</enum><text>investments in redevelopment, new construction, new capacity, efficiency, modernization, rehabilitation, and safety improvements; and</text>
 </clause><clause commented="no" id="HAA62A52D61974B16A96D05BFCFCA33AB"><enum>(ii)</enum><text>investments in environmental, recreation, and other protection, mitigation, or enhancement measures that will be required or authorized by the license; and</text>
 </clause></subparagraph><subparagraph commented="no" id="H5D7D97ADA9404B898E312003C5DF2D88"><enum>(B)</enum><text>investments made by the licensee over the term of the existing license (including any terms under annual licenses), beyond those required by the existing license when issued, that—</text>
 <clause commented="no" id="HA58FDEFC313049D598A53C9E7CF699D9"><enum>(i)</enum><text>resulted in, during the term of the existing license—</text> <subclause commented="no" id="HBDB8B7048D8140D5841FFA9A01ECE632"><enum>(I)</enum><text>redevelopment, new construction, new capacity, efficiency, modernization, rehabilitation, or safety improvements; or</text>
 </subclause><subclause commented="no" id="H11291CA515CA4F0982AFC0E97F03E327"><enum>(II)</enum><text>environmental, recreation, or other protection, mitigation, or enhancement measures; and</text> </subclause></clause><clause commented="no" id="HB8E5B90391C4495C864261A8C6CDA11D"><enum>(ii)</enum><text>did not result in the extension of the term of the existing license by the Commission.</text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB313BEC3210B4D4CA7C359A238CDE715"><enum>(f)</enum><header display-inline="yes-display-inline">Alternative conditions and prescriptions</header><text display-inline="yes-display-inline">Section 33 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/823d">16 U.S.C. 823d</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H8D0B9BA4D8884E078096E4FC0490116F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H09E8705F138A4170B8C788B38FE42B58"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>deems</quote> and inserting <quote>determines</quote>;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEBAAA64C10FE42A0AE366777DC2D8730"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)(B), in the matter preceding clause (i), by inserting <quote>determined to be necessary</quote> before <quote>by the Secretary</quote>;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H18B7885B1C574E8189474E9D83EAC799"><enum>(C)</enum><text display-inline="yes-display-inline">by striking paragraph (4); and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFD7E28B61C684CD4B15A0D53D784AFA7"><enum>(D)</enum><text display-inline="yes-display-inline">by striking paragraph (5);</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6D98AB1AB76F4865BDF79D698DC44EC2"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H75DA8E4F70A645ECA6A4AF288AFE378E"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (4); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H93A081CF6C524465820BFE4930A2EF69"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (5); and</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA9EE34C6311F4A2A8A9F0E2185D67BD4"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

 <subsection commented="no" display-inline="no-display-inline" id="H13F03BADE3F74055BC3AB34A88850675"><enum>(c)</enum><header display-inline="yes-display-inline">Further conditions</header><text display-inline="yes-display-inline">This section applies to any further conditions or prescriptions proposed or imposed pursuant to section 4(e), 6, or 18.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HE6347974AAE04CC9B933C81B49601F60" section-type="subsequent-section"><enum>3.</enum><header>Hydropower licensing and process improvements</header>
 <subsection id="H11084AF54BB844A995F1C14C4BEBC061"><enum>(a)</enum><header>Hydropower licensing and process improvements</header><text>Part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="HIF00" id="HBE264B99D40046DE853A66001B65E719" reported-display-style="italic">
					<section id="HFEBFD76CB74C42C4B4A64054143B04ED"><enum>34.</enum><header>Hydropower licensing and process improvements</header>
 <subsection id="H5E72AE99AB6A4F839576686331C8CC1E"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>Federal authorization</term>—</text> <paragraph id="HF593A5A1B3F74E09BF44F4DBF09218C9"><enum>(1)</enum><text>means any authorization required under Federal law with respect to an application for a license under this part; and<italic></italic></text>
 </paragraph><paragraph id="HDAC8C9E2E5E6443D8E2AA72B7F9C39C8"><enum>(2)</enum><text>includes any permits, special use authorizations, certifications, opinions, or other approvals as may be required under Federal law to approve or implement the license under this part.</text>
							</paragraph></subsection><subsection id="HA578FF4C6FEC43F385CAD47D1DB6C4FE"><enum>(b)</enum><header>Designation as lead agency</header>
 <paragraph id="H3B58507CC1934FB4B6A1DAD642C27636"><enum>(1)</enum><header>In general</header><text>The Commission shall act as the lead agency for the purposes of coordinating all applicable Federal authorizations and for the purposes of complying with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text>
							</paragraph><paragraph id="HB2A3C7073AF54580B97891B66BD2D9BE"><enum>(2)</enum><header>Other agencies and Indian tribes</header>
 <subparagraph id="H776F2D1176E04E54A8E26AD6456091C4"><enum>(A)</enum><header>In general</header><text>Each Federal, State, and local government agency and Indian tribe considering an aspect of an application for Federal authorization shall coordinate with the Commission and comply with the deadline established in the schedule developed for the license under this part in accordance with the rule issued by the Commission under subsection (c).</text>
 </subparagraph><subparagraph id="H9C39E7A1F8024117A0D6FFD3C8A87F95"><enum>(B)</enum><header>Identification</header><text>The Commission shall identify, as early as practicable after it is notified by the applicant for a license under this part, any Federal or State agency, local government, or Indian tribe that may consider an aspect of an application for a Federal authorization.</text>
								</subparagraph><subparagraph id="HB890D496390A417A9FEAF108DF910784"><enum>(C)</enum><header>Notification</header>
 <clause id="HB37729002197445EBECF817749713F1C"><enum>(i)</enum><header>In general</header><text>The Commission shall notify any agency and Indian tribe identified under subparagraph (B) of the opportunity to participate in the process of reviewing an aspect of an application for a Federal authorization.</text>
 </clause><clause id="H3C64802AEE8E408F8622C444A7A9E375"><enum>(ii)</enum><header>Deadline</header><text>Each agency and Indian tribe receiving a notice under clause (i) shall submit a response acknowledging receipt of the notice to the Commission within 30 days of receipt of such notice and request.</text>
									</clause></subparagraph><subparagraph id="H006D91914FC4440C8BF2C51A0103E1B3"><enum>(D)</enum><header>Issue identification and resolution</header>
 <clause id="H89B97CAA4078435992B15E1EC9D80597"><enum>(i)</enum><header>Identification of issues</header><text>Federal, State, and local government agencies and Indian tribes that may consider an aspect of an application for Federal authorization shall identify, as early as possible, and share with the Commission and the applicant, any issues of concern identified during the pendency of the Commission’s action under this part relating to any Federal authorization that may delay or prevent the granting of such authorization, including any issues that may prevent the agency or Indian tribe from meeting the schedule established for the license under this part in accordance with the rule issued by the Commission under subsection (c).</text>
 </clause><clause commented="no" id="H0F7E8D5C8D9F48C399AFFEBA42F23D54"><enum>(ii)</enum><header>Issue resolution</header><text display-inline="yes-display-inline">The Commission may forward any issue of concern identified under clause (i) to the heads of the relevant State and Federal agencies (including, in the case of an issue of concern identified by a State or local government agency or Indian tribe, the Federal agency overseeing the delegated authority, or the Secretary of the Interior with regard to an issue of concern identified by an Indian tribe, as applicable) for resolution. If the Commission forwards an issue of concern to the head of a relevant agency, the Commission and the relevant agency shall enter into a memorandum of understanding to facilitate interagency coordination and resolution of such issues of concern, as appropriate.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="HEBBD844AC88548DC8E90DCAA9F1D41E4"><enum>(c)</enum><header>Schedule</header>
 <paragraph id="H69C6628BDCE44C22879B0CB7C67E9BD4"><enum>(1)</enum><header>Commission rulemaking to establish process to set schedule</header><text>Not later than 180 days after the date of enactment of this section the Commission shall, in consultation with the appropriate Federal agencies, issue a rule, after providing for notice and public comment, establishing a process for setting a schedule following the filing of an application under this part for a license for the review and disposition of each Federal authorization.</text>
 </paragraph><paragraph id="HC0C39D2A60D549C39BECA82E3F6A3F89"><enum>(2)</enum><header>Elements of scheduling rule</header><text>In issuing a rule under this subsection, the Commission shall ensure that the schedule for each Federal authorization—</text>
 <subparagraph id="H004551DC68AA4452B157D8B8EE60EE3F"><enum>(A)</enum><text>includes deadlines for actions by—</text> <clause id="HB929957EE2F340798A25396ED6C39583"><enum>(i)</enum><text>any Federal or State agency, local government, or Indian tribe that may consider an aspect of an application for the Federal authorization;</text>
 </clause><clause id="H1DAD11208FDA4E80A0BB5AA3CCD8F03B"><enum>(ii)</enum><text>the applicant;</text> </clause><clause id="H9CEFB6A3B5EA4186B2D29B3CA5CF8C17"><enum>(iii)</enum><text>the Commission; and</text>
 </clause><clause id="H096CA990AAC9483B9F26F56DF557F82B"><enum>(iv)</enum><text>other participants in any applicable proceeding;</text> </clause></subparagraph><subparagraph id="H05B2A2E0ED54445CB25FCD0E9AEACF2F"><enum>(B)</enum><text>is developed in consultation with the applicant and any agency and Indian tribe that submits a response under subsection (b)(2)(C)(ii);</text>
 </subparagraph><subparagraph id="HDBBA22F41B6C4DBC80E502F42F4BF53C"><enum>(C)</enum><text>provides an opportunity for any Federal or State agency, local government, or Indian tribe that may consider an aspect of an application for the applicable Federal authorization to identify and resolve issues of concern, as provided in subsection (b)(2)(D);</text>
 </subparagraph><subparagraph id="H334DBAC08B9C4CB9BE85BC21BB1DC9F3"><enum>(D)</enum><text>complies with applicable schedules established under Federal and State law;</text> </subparagraph><subparagraph id="H26FFA3D7419240A9B0CEB405D4883F91"><enum>(E)</enum><text>ensures expeditious completion of all proceedings required under Federal and State law, to the extent practicable; and</text>
 </subparagraph><subparagraph id="H5FA7609E50F6463AA9B2095AECA1213C"><enum>(F)</enum><text>facilitates completion of Federal and State agency studies, reviews, and any other procedures required prior to, or concurrent with, the preparation of the Commission’s environmental document required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text>
								</subparagraph></paragraph></subsection><subsection id="HE0173C143B874A5EB279C9986CDEAE3C"><enum>(d)</enum><header>Transmission of final schedule</header>
 <paragraph id="H042BF56E019F4806ABC4C21602769853"><enum>(1)</enum><header>In General</header><text display-inline="yes-display-inline">For each application for a license under this part, the Commission shall establish a schedule in accordance with the rule issued by the Commission under subsection (c). The Commission shall publicly notice and transmit the final schedule to the applicant and each agency and Indian tribe identified under subsection (b)(2)(B).</text>
 </paragraph><paragraph id="HB3D1644A9CF744A4BBD28A1EE374BBF8"><enum>(2)</enum><header>Response</header><text>Each agency and Indian tribe receiving a schedule under this subsection shall acknowledge receipt of such schedule in writing to the Commission within 30 days.</text>
 </paragraph></subsection><subsection id="H57DB8AB5394C44DDBAF7EE048D6EC3E1"><enum>(e)</enum><header>Adherence to schedule</header><text>All applicants, other licensing participants, and agencies and Indian tribes considering an aspect of an application for a Federal authorization shall meet the deadlines set forth in the schedule established pursuant to subsection (d)(1).</text>
 </subsection><subsection id="H9B53381C2418413CA24A5E8C336467A6"><enum>(f)</enum><header>Application processing</header><text>The Commission, Federal, State, and local government agencies, and Indian tribes may allow an applicant seeking a Federal authorization to fund a third-party contractor selected by such an agency or tribe to assist in reviewing the application. All costs of an agency or tribe incurred pursuant to direct funding by the applicant, including all costs associated with the third party contractor, shall not be considered costs of the United States for the administration of this part under section 10(e).</text>
 </subsection><subsection id="H85A84BBAC0AC4D68B2649BD1AE6C9CA6"><enum>(g)</enum><header>Commission recommendation on scope of environmental review</header><text>For the purposes of coordinating Federal authorizations for each license under this part, the Commission shall consult with and make a recommendation to agencies and Indian tribes receiving a schedule under subsection (d) on the scope of the environmental review for all Federal authorizations for such license. Each Federal and State agency and Indian tribe shall give due consideration and may give deference to the Commission’s recommendations, to the extent appropriate under Federal law.</text>
						</subsection><subsection commented="no" id="H234D4DACC3F04E7A9749D035A89E0CDA"><enum>(h)</enum><header>Extension of deadline</header>
 <paragraph id="H866D54AFAD9E49C29CB6589F0FD37457"><enum>(1)</enum><header>Application</header><text>A Federal, State, or local government agency or Indian tribe that is unable to complete its disposition of a Federal authorization by the deadline set forth in the schedule established under subsection (d)(1) shall, not later than 30 days prior to such deadline, file for an extension with the Commission.</text>
 </paragraph><paragraph id="H01AA797C15614AF29D2E2371FCA733E4"><enum>(2)</enum><header>Extension</header><text>The Commission shall only grant an extension filed for under paragraph (1) if the agency or Indian tribe demonstrates, based on the record maintained under subsection (i), that complying with the schedule established under subsection (d)(1) would prevent the agency or tribe from complying with applicable Federal or State law. If the Commission grants the extension, the Commission shall set a reasonable schedule and deadline, that is not later than 90 days after the deadline set forth in the schedule established under subsection (d)(1), for the agency or tribe to complete its disposition of the Federal authorization.</text>
 </paragraph></subsection><subsection commented="no" id="H1557DA11F3B34F88857451613F6C16DB"><enum>(i)</enum><header>Consolidated record</header><text>The Commission shall, with the cooperation of Federal, State, and local government agencies and Indian tribes, maintain a complete consolidated record of all decisions made or actions taken by the Commission or by a Federal administrative agency or officer (or State or local government agency or officer or Indian tribe acting under delegated Federal authority) with respect to any Federal authorization. Such record shall constitute the record for judicial review under section 313(b).</text>
						</subsection><subsection commented="no" id="H1C184A5BA4AD482F8D55DED880699549"><enum>(j)</enum><header>Submission of license recommendations, conditions, and prescriptions</header>
 <paragraph commented="no" id="H4661FF3EE94943099A8AD5A9C5F9EA70"><enum>(1)</enum><header>Submission of recommendations</header><text>Any Federal or State agency that is providing recommendations with respect to a license proceeding under this part shall submit to the Commission for inclusion in the consolidated record relating to the license proceeding maintained under subsection (i)—</text>
 <subparagraph commented="no" id="H13367667B11941EB9EFA2A6169D0172C"><enum>(A)</enum><text>the recommendations;</text> </subparagraph><subparagraph commented="no" id="H45AF83907AD94731A5C5CF003CA480DB"><enum>(B)</enum><text>the rationale for the recommendations; and</text>
 </subparagraph><subparagraph commented="no" id="H3057814926444C2893098E23E17C36E9"><enum>(C)</enum><text>any supporting materials relating to the recommendations.</text> </subparagraph></paragraph><paragraph commented="no" id="H02AE04C03E824F5A8B7F9965E578ADE0"><enum>(2)</enum><header>Written statement</header><text>In a case in which a Federal agency is making a determination with respect to a covered measure (as defined in section 35(a)), the head of the Federal agency shall submit to the Commission for inclusion in the consolidated record, in addition to the information required under paragraph (1), a written statement demonstrating that the Federal agency gave equal consideration to the effects of the covered measure on—</text>
 <subparagraph commented="no" id="H58B5E11CA4BC44939C97643BBE0E420D"><enum>(A)</enum><text>energy supply, distribution, cost, and use;</text> </subparagraph><subparagraph commented="no" id="H1B73201FFF6046EDB436076E651EAD7E"><enum>(B)</enum><text>flood control;</text>
 </subparagraph><subparagraph commented="no" id="H10847F9FE70A48BE8D708ED7DA14AE3E"><enum>(C)</enum><text>navigation;</text> </subparagraph><subparagraph commented="no" id="HF80E8A8D36DE45D19BDD8EE78442DEFC"><enum>(D)</enum><text>water supply; and</text>
 </subparagraph><subparagraph commented="no" id="H3D7B833518A244229CB134D21BCBF7FC"><enum>(E)</enum><text>air quality and the preservation of other aspects of environmental quality.</text> </subparagraph></paragraph><paragraph commented="no" id="H08FDF5D1466B4623BAC1D2283A7E1E23"><enum>(3)</enum><header>Information from other agencies</header><text display-inline="yes-display-inline">In preparing a written statement under paragraph (2), the head of a Federal agency may make use of information produced or made available by other agencies with relevant expertise in the factors described in subparagraphs (A) through (E) of that paragraph.</text>
 </paragraph></subsection><subsection commented="no" id="H22FF518254464AF39DC533224ACC4F57"><enum>(k)</enum><header>Delegation</header><text display-inline="yes-display-inline">A Secretary may delegate the authority to determine a condition to be necessary under section 4(e), or to prescribe a fishway under section 18, to an officer of the applicable department based, in part, on the ability of the officer to evaluate the broad effects of such condition or prescription on—</text>
 <paragraph id="H568DFCA5B8F747CDBE745E72B0C0CF6D"><enum>(1)</enum><text>the applicable project; and</text> </paragraph><paragraph id="HA827B3A4D6C94663BEDE862342F2E117"><enum>(2)</enum><text>the factors described in subparagraphs (A) through (E) of subsection (j)(2).</text>
 </paragraph></subsection><subsection commented="no" id="H55B4FD796DC847639164D353A375E1C3"><enum>(l)</enum><header>No effect on other laws</header><text>Nothing in this section shall be construed to affect any requirement of the Federal Water Pollution Control Act, the Fish and Wildlife Coordination Act, the Endangered Species Act of 1973, section 14 of the Act of March 3, 1899 (commonly known as the Rivers and Harbors Appropriation Act of 1899), and those provisions in subtitle III of title 54, United States Code commonly known as the National Historic Preservation Act, with respect to an application for a license under this part.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="H82649D645AF94D238923F30F1F33C163" section-type="subsequent-section"><enum>35.</enum><header display-inline="yes-display-inline">Trial-type hearings</header>
 <subsection commented="no" display-inline="no-display-inline" id="H5BF588CD271A4664AFC73F9CB7804956"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of covered measure</header><text display-inline="yes-display-inline">In this section, the term <term>covered measure</term> means—</text> <paragraph commented="no" display-inline="no-display-inline" id="H6FED16C60ECD424383BADBE2B78EBDCF"><enum>(1)</enum><text display-inline="yes-display-inline">a condition determined to be necessary under section 4(e), including an alternative condition proposed under section 33(a);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6A92A2F8E3B84B6B90CB9C3221951EE5"><enum>(2)</enum><text display-inline="yes-display-inline">fishways prescribed under section 18, including an alternative prescription proposed under section 33(b); or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H42A2EF44CEEA451B877CBF7B59C4C55C"><enum>(3)</enum><text display-inline="yes-display-inline">any action by the Secretary to exercise reserved authority under the license to prescribe, submit, or revise any condition to a license under the first proviso of section 4(e) or fishway prescribed under section 18.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBEED63EC681140B2AE5B7AD1EED4E8F7"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of trial-type hearing</header><text display-inline="yes-display-inline">An applicant for a license under this part (including an applicant for a license under section 15) and any party to a license proceeding shall be entitled to a determination on the record, after opportunity for a trial-type hearing of not more than 120 days, on any disputed issues of material fact with respect to an applicable covered measure.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H0A4D8C3565444C269EA975D89AD82A6C"><enum>(c)</enum><header display-inline="yes-display-inline">Deadline for request</header><text display-inline="yes-display-inline">A request for a trial-type hearing under this section shall be submitted not later than 60 days after the date on which, as applicable—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HAD34CE2656DC4CA8AA949FB312385AE2"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary determines the condition to be necessary under section 4(e) or prescribes the fishway under section 18; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDC4DFBBE90B64EFDBD5A2D62B7E5D4CF"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary exercises reserved authority under the license to prescribe, submit, or revise any condition to a license under the first proviso of section 4(e) or fishway prescribed under section 18, as appropriate.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFFCA1C7D50854C109715FB580D0DBCB1"><enum>(d)</enum><header display-inline="yes-display-inline">No requirement to exhaust</header><text display-inline="yes-display-inline">By electing not to request a trial-type hearing under subsection (c), a license applicant and any other party to a license proceeding shall not be considered to have waived the right of the applicant or other party to raise any issue of fact or law in a non-trial-type proceeding, but no issue may be raised for the first time on rehearing or judicial review of the license decision of the Commission.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H0688DE901E76428D907EAB66431A5489"><enum>(e)</enum><header display-inline="yes-display-inline">Administrative Law Judge</header>
 <paragraph id="HEDE474125FEC4838A0ED219C5036E0BC"><enum>(1)</enum><header>In general</header><text>All disputed issues of material fact raised by a party in a request for a trial-type hearing submitted under subsection (c) shall be determined in a single trial-type hearing to be conducted by an Administrative Law Judge within the Office of Administrative Law Judges and Dispute Resolution of the Commission, in accordance with the Commission rules of practice and procedure under part 385 of title 18, Code of Federal Regulations (or successor regulations), and within the timeframe established by the Commission for each license proceeding (including a proceeding for a license under section 15) under section 34(d).</text>
 </paragraph><paragraph commented="no" id="H0F86482A19C04E2CBB90E8D1EA3DEF5E"><enum>(2)</enum><header>Requirement</header><text>The trial-type hearing shall include the opportunity—</text> <subparagraph commented="no" id="HA1222DD5DCF74AD7A42223D92CE202CF"><enum>(A)</enum><text>to undertake discovery; and</text>
 </subparagraph><subparagraph commented="no" id="H37878B4224C8406EA5ECE364044C6165"><enum>(B)</enum><text>to cross-examine witnesses, as applicable.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H57452F70AC6C422B8A19422174128F34"><enum>(f)</enum><header display-inline="yes-display-inline">Stay</header><text display-inline="yes-display-inline">The Administrative Law Judge may impose a stay of a trial-type hearing under this section for a period of not more than 120 days to facilitate settlement negotiations relating to resolving the disputed issues of material fact with respect to the covered measure.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H813B483714604AC5B8391FB17D50F240"><enum>(g)</enum><header display-inline="yes-display-inline">Decision of the Administrative Law Judge</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H6BC4F50426C64EB7BA0C68BB39C0294B"><enum>(1)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The decision of the Administrative Law Judge shall contain—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H9BC659407B584EDEAFA574A67533476E"><enum>(A)</enum><text display-inline="yes-display-inline">findings of fact on all disputed issues of material fact;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H502BE9AEDCAC4479B39513EE050A236B"><enum>(B)</enum><text display-inline="yes-display-inline">conclusions of law necessary to make the findings of fact, including rulings on materiality and the admissibility of evidence; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAF3013B348A248D18CD1A46333C73CD5"><enum>(C)</enum><text display-inline="yes-display-inline">reasons for the findings and conclusions.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8156FB9920B94AF08EF2DA685687637F"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The decision of the Administrative Law Judge shall not contain conclusions as to whether—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HFD3D06C2473241289A2671760ED63BE2"><enum>(A)</enum><text display-inline="yes-display-inline">any condition or prescription should be adopted, modified, or rejected; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H047FDCB3F4534D00A0EC54FEBDE39B1B"><enum>(B)</enum><text display-inline="yes-display-inline">any alternative condition or prescription should be adopted, modified, or rejected.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBBC0BC8F749442849392D5A41498021B"><enum>(3)</enum><header display-inline="yes-display-inline">Finality</header><text display-inline="yes-display-inline">A decision of an Administrative Law Judge under this section with respect to a disputed issue of material fact shall not be subject to further administrative review.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H997C4CD31A764A7F84AAD97562155DD5"><enum>(4)</enum><header display-inline="yes-display-inline">Service</header><text display-inline="yes-display-inline">The Administrative Law Judge shall serve the decision on each party to the hearing and forward the complete record of the hearing to the Commission and the Secretary that proposed the original condition or prescription.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCF1B15FC065545DF9A180B56F37A441E"><enum>(h)</enum><header display-inline="yes-display-inline">Secretarial determination</header>
 <paragraph commented="no" display-inline="no-display-inline" id="HBD61655AA9F143B4B9A1215591093488"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date on which the Administrative Law Judge issues the decision under subsection (g) and in accordance with any applicable schedule established by the Commission under section 34(d), the Secretary proposing a covered measure shall file with the Commission a final determination to adopt, modify, or withdraw any condition or prescription that was the subject of a hearing under this section, based on the decision of the Administrative Law Judge.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCDF80FF7DFE84AECA5E6814A468C9BC0"><enum>(2)</enum><header display-inline="yes-display-inline">Record of determination</header><text display-inline="yes-display-inline">The final determination of the Secretary filed with the Commission shall identify the reasons for the decision and any considerations taken into account that were not part of, or were inconsistent with, the findings of the Administrative Law Judge and shall be included in the consolidated record maintained under section 34(i).</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD10E57D224E54B32971B725F1E7F2607"><enum>(i)</enum><header display-inline="yes-display-inline">Resolution of matters</header><text display-inline="yes-display-inline">Notwithstanding sections 4(e) and 18, if the Commission finds that a final determination under (h)(1) of the Secretary is inconsistent with the purposes of this part or other applicable law, the Commission may enter into a memorandum of understanding with the Secretary to facilitate interagency coordination and resolve the matter.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HAC867B4A3DAA46CF889A7F4C481C55FC"><enum>(j)</enum><header display-inline="yes-display-inline">Judicial review</header><text display-inline="yes-display-inline">The decision of the Administrative Law Judge and the record of determination of the Secretary shall be included in the record of the applicable licensing proceeding and subject to judicial review of the final licensing decision of the Commission under section 313(b).</text>
						</subsection></section><section id="H75ED6413E9BB49908FAA87E5AA7A3B21"><enum>36.</enum><header>Licensing study improvements</header>
 <subsection id="H13BDF3B22CB548E1BC85F8F6E64E7FF9"><enum>(a)</enum><header>In general</header><text>To facilitate the timely and efficient completion of the license proceedings under this part, the Commission shall, in consultation with applicable Federal and State agencies and interested members of the public—</text>
 <paragraph id="H68E33D08269444D2B9D5F0B29404C727"><enum>(1)</enum><text>compile current and accepted best practices in performing studies required in such license proceedings, including methodologies and the design of studies to assess the full range of environmental impacts of a project that reflect the most recent peer-reviewed science;</text>
 </paragraph><paragraph id="H1C41555D066D43A3A6134A81CA239D54"><enum>(2)</enum><text>compile a comprehensive collection of studies and data accessible to the public that could be used to inform license proceedings under this part; and</text>
 </paragraph><paragraph id="H586EFEB534E842948A1C88A2038E7A0E"><enum>(3)</enum><text>encourage license applicants, agencies, and Indian tribes to develop and use, for the purpose of fostering timely and efficient consideration of license applications, a limited number of open-source methodologies and tools applicable across a wide array of projects, including water balance models and streamflow analyses.</text>
 </paragraph></subsection><subsection commented="no" id="H6C2839173F2D46D4A6CE94D02927B0E1"><enum>(b)</enum><header>Use of studies</header><text>To the extent practicable, the Commission and other Federal, State, and local government agencies and Indian tribes considering an aspect of an application for Federal authorization (as defined in section 34) shall use studies and data based on current, accepted science in support of their actions. Any participant in a proceeding with respect to such a Federal authorization shall demonstrate that a study requested by the participant is not duplicative of current, existing studies that are applicable to the project.</text>
 </subsection><subsection commented="no" id="H74CE97D1AE114E2188C34A457E2DC5D5"><enum>(c)</enum><header>Intra-watershed review</header><text display-inline="yes-display-inline">The Commission shall establish a program to develop comprehensive plans, at the request of project applicants, on a watershed-wide scale, in consultation with the applicants, appropriate Federal agencies, and affected States, local governments, and Indian tribes, in watersheds with respect to which there are more than one application for a project. Upon such a request, the Commission, in consultation with the applicants, such Federal agencies, and affected States, local governments, and Indian tribes, may conduct or commission watershed-wide environmental studies, with the participation of at least 2 applicants. Any study conducted under this subsection shall apply only to a project with respect to which the applicants participate.</text>
						</subsection></section><section id="H6FB2FBB3D2EE426888ACD7105556C229"><enum>37.</enum><header>License amendment improvements</header>
						<subsection id="H8F358C23D8CB418EB08025DE15DC3249"><enum>(a)</enum><header>Qualifying project upgrades</header>
 <paragraph id="H2833929FBC1948A3A8DBF4EAFC348BE5"><enum>(1)</enum><header>In general</header><text>As provided in this section, the Commission may approve an application under this section for an amendment to a license issued under this part for a qualifying project upgrade.</text>
 </paragraph><paragraph commented="no" id="HF8745E125DBA46F692B7143ED7C2C442"><enum>(2)</enum><header>Application</header><text>A licensee filing an application for an amendment to a project license, for which the licensee is seeking approval as a qualified project upgrade under this section, shall include in such application information sufficient to demonstrate that the proposed change to the project described in the application is a qualifying project upgrade.</text>
 </paragraph><paragraph id="H5C80180D0B4D406FA370466DAAAD9C84"><enum>(3)</enum><header>Notice and initial determination on qualification</header><text>Not later than 30 days after receipt of an application under paragraph (2), the Commission, in consultation with other Federal agencies, States, and Indian tribes the Commission determines appropriate, shall publish in the Federal Register a notice containing—</text>
 <subparagraph id="HA5804AE47A0B422580F93AEF0E2E9498"><enum>(A)</enum><text>notice of the application filed under paragraph (2);</text> </subparagraph><subparagraph id="HBF2CAE73FC3445BF9E2BFF630D3D961D"><enum>(B)</enum><text>an initial determination as to whether the proposed change to the project described in the application for a license amendment is a qualifying project upgrade; and</text>
 </subparagraph><subparagraph id="H517629CE4716494A8F6750B398122998"><enum>(C)</enum><text>a request for public comment on the application and the initial determination.</text> </subparagraph></paragraph><paragraph commented="no" id="H2388EE9B660A4BDC8F08898DCDF9A983"><enum>(4)</enum><header>Public comment and consultation</header><text>The Commission shall, for a period of 45 days beginning on the date of publication of a notice under paragraph (3)—</text>
 <subparagraph id="H35F6E40A62E34620A87CB26C3D333F86"><enum>(A)</enum><text display-inline="yes-display-inline">accept public comment regarding the application and whether the proposed license amendment is for a qualifying project upgrade; and</text>
 </subparagraph><subparagraph commented="no" id="H31ACEFE74E6B4262B3F8996AD5A8BD63"><enum>(B)</enum><text display-inline="yes-display-inline">consult with each Federal, State, and local government agency and Indian tribe considering an aspect of an application for any authorization required under Federal law with respect to the proposed license amendment, as well as other interested agencies and Indian tribes.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H58BDC36901EF44E2AE4DEF9042150C6A"><enum>(5)</enum><header>Final determination on qualification</header><text display-inline="yes-display-inline">Not later than 15 days after the end of the public comment and consultation period under paragraph (4), the Commission shall publish in the Federal Register a final determination as to whether the proposed license amendment is for a qualifying project upgrade.</text>
 </paragraph><paragraph commented="no" id="HB594F786FEEF46B2A2B3F4F061C02436"><enum>(6)</enum><header>Federal authorizations</header><text display-inline="yes-display-inline">In establishing the schedule for a proposed license amendment for a qualifying project upgrade, the Commission shall require final disposition of all authorizations required under Federal law with respect to an application for such license amendment, other than final action by the Commission, by not later than 120 days after the date on which the Commission publishes a final determination under paragraph (5) that the proposed license amendment is for a qualifying project upgrade.</text>
 </paragraph><paragraph id="H92060384D6C94D88AEF1BAC68609444D"><enum>(7)</enum><header>Commission action</header><text display-inline="yes-display-inline">Not later than 150 days after the date on which the Commission publishes a final determination under paragraph (5) that a proposed license amendment is for a qualifying project upgrade, the Commission shall take final action on the license amendment application.</text>
 </paragraph><paragraph id="H19002D7CC0094F9488ACE0CE88B120F0"><enum>(8)</enum><header>License amendment conditions</header><text>Any condition or prescription included in or applicable to a license amendment for a qualifying project upgrade approved under this subsection, including any condition, prescription, or other requirement of a Federal authorization, shall be limited to those that are—</text>
 <subparagraph id="HB0080257DF7B49F2AF3848B0106A1735"><enum>(A)</enum><text>necessary to protect public safety; or</text> </subparagraph><subparagraph id="H28733B90CCC6417DB488AD552D6D12B9"><enum>(B)</enum><text>reasonable, economically feasible, and essential to prevent loss of or damage to, or to mitigate adverse effects on, fish and wildlife resources, water supply, and water quality that are directly caused by the construction and operation of the qualifying project upgrade, as compared to the environmental baseline existing at the time the Commission approves the application for the license amendment.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H264911A004094F118CE208DED0B56723"><enum>(9)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of enactment of this section, the Commission shall, after notice and opportunity for public comment, issue a rule to implement this subsection.</text>
 </paragraph><paragraph id="HAFE03B21262C4A1084F03F60BF6DB4CD"><enum>(10)</enum><header>Definitions</header><text>For purposes of this subsection:</text> <subparagraph commented="no" id="HEE41E5CC186A4675A33583AD1E969670"><enum>(A)</enum><header>Qualifying project upgrade</header><text>The term <term>qualifying project upgrade</term> means a change to a project licensed under this part that meets the qualifying criteria, as determined by the Commission.</text>
 </subparagraph><subparagraph id="H866CFEBB2F2C406BA0804C28F01F2689"><enum>(B)</enum><header>Qualifying criteria</header><text>The term <term>qualifying criteria</term> means, with respect to a project licensed under this part, a change to the project that—</text> <clause id="H5A6FE8912FC64BF4BD4EBCABAA7E367D"><enum>(i)</enum><text>if carried out, would be unlikely to adversely affect any species listed as threatened or endangered under the Endangered Species Act of 1973 or result in the destruction or adverse modification of critical habitat, as determined in consultation with the Secretary of the Interior or Secretary of Commerce, as appropriate, in accordance with section 7 of the Endangered Species Act of 1973;</text>
 </clause><clause id="H4CE69A2C604B4E2887D308BD232BD849"><enum>(ii)</enum><text>is consistent with any applicable comprehensive plan under section 10(a)(2);</text> </clause><clause id="H328B4EE17F084BD6B5E1A17877AA0F68"><enum>(iii)</enum><text>includes only changes to project lands, waters, or operations that, in the judgment of the Commission, would result in only insignificant or minimal cumulative adverse environmental effects;</text>
 </clause><clause id="HA892AC954D77415BB93BDCB37F4CAB2E"><enum>(iv)</enum><text>would be unlikely to adversely affect water quality or water supply; and</text> </clause><clause commented="no" id="HDCDE2B2AAFA64BAFB68DC7D50972D40F"><enum>(v)</enum><text>proposes to implement—</text>
 <subclause commented="no" id="H4ECC5F722EFB4B9D88D01936C3FBC30D"><enum>(I)</enum><text>capacity increases, efficiency improvements, or other enhancements to hydropower generation at the licensed project;</text>
 </subclause><subclause commented="no" id="H50FE4CA2AB494D7799B6E64ACBC1D65B"><enum>(II)</enum><text>environmental protection, mitigation, or enhancement measures to benefit fish and wildlife resources or other natural and cultural resources; or</text>
 </subclause><subclause commented="no" id="H46D7483191634F49B8C42DD877AE1AF7"><enum>(III)</enum><text>improvements to public recreation at the licensed project.</text> </subclause></clause></subparagraph></paragraph></subsection><subsection id="H3D47D59887FA46E1BACB76A4FF074B25"><enum>(b)</enum><header>Amendment approval processes</header> <paragraph id="H510795EC245B4CF38DA910897FBBCC70"><enum>(1)</enum><header>Rule</header><text>Not later than 1 year after the date of enactment of this section, the Commission shall, after notice and opportunity for public comment, issue a rule establishing new standards and procedures for license amendment applications under this part. In issuing such rule, the Commission shall seek to develop the most efficient and expedient process, consultation, and review requirements, commensurate with the scope of different categories of proposed license amendments. Such rule shall account for differences in environmental effects across a wide range of categories of license amendment applications.</text>
 </paragraph><paragraph commented="no" id="HC8EB29711F39450C82871AFB6B17EFF8"><enum>(2)</enum><header>Capacity</header><text display-inline="yes-display-inline">In issuing a rule under this subsection, the Commission shall take into consideration that a change in generating or hydraulic capacity may indicate the potential environmental effects of a proposed license amendment but is not determinative of such effects.</text>
 </paragraph><paragraph commented="no" id="H4C6552BBCD934B10ABD2C6806F09D2FF"><enum>(3)</enum><header>Process options</header><text display-inline="yes-display-inline">In issuing a rule under this subsection, the Commission shall take into consideration the range of process options available under the Commission’s regulations for license applications and adapt such options to amendment applications, where appropriate.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H16B03AE76C064B5A88AD631AE84937B7"><enum>4.</enum><header>Technical and conforming amendments</header>
 <subsection id="HA50BFC6782674662B237452378DEDE44"><enum>(a)</enum><header>Licenses</header><text display-inline="yes-display-inline">Section 4(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/797">16 U.S.C. 797(e)</external-xref>) is amended—</text> <paragraph id="H05CF651D8DB24236A2A5F5CA2309FEA7"><enum>(1)</enum><text>by striking <quote>adequate protection and utilization of such reservation</quote> and all that follows through <quote>That no license affecting the navigable capacity</quote> and inserting <quote>adequate protection and utilization of such reservation: <italic>Provided further, </italic>That no license affecting the navigable capacity</quote>; and</text>
 </paragraph><paragraph id="H0CF96E2E764A4419B1E2FD9FE8221B3F"><enum>(2)</enum><text>by striking <quote>deem</quote> and inserting <quote>determine</quote>.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1B001441C962430B8DF8DB90139009DB"><enum>(b)</enum><header display-inline="yes-display-inline">Operation of navigation facilities</header><text display-inline="yes-display-inline">Section 18 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/811">16 U.S.C. 811</external-xref>) is amended by striking the second, third, and fourth sentences.</text>
