 <section id="H78FD8BC28B2847B48534F663DB8ABEFF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect and Serve Act of 2018</short-title></quote>.</text> </section><section id="HF6CD368F086F4E7E933BD966B96A1EB1"><enum>2.</enum><header>Crimes targeting law enforcement officers</header> <subsection id="HF317DFD7CF434C50B827AE9C8F34B578"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">Chapter 7</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="HA17AAB5053EB4EAAA81EE5A7F00CCF75" style="USC">
					<section id="HCAE6DB59DC7D4FEA9C617CAE78469D42"><enum>120.</enum><header>Crimes targeting law enforcement officers</header>
 <subsection id="H47B04AD650A246AE95A6CC17A51DB038"><enum>(a)</enum><header>In general</header><text>Whoever, in any circumstance described in subsection (b), knowingly causes serious bodily injury to a law enforcement officer, or attempts to do so—</text>
 <paragraph id="HC5543BE8F6BE48BB9A0FB1AB368864AF"><enum>(1)</enum><text>shall be imprisoned not more than 10 years, fined in accordance with this title, or both; and</text> </paragraph><paragraph id="H69E211CE5223493293C5151E34DFE134"><enum>(2)</enum><text>shall be imprisoned for any term of years or for life, fined in accordance with this title, or both, if—</text>
 <subparagraph id="H26F8A717F43B427189226A9FB134CB56"><enum>(A)</enum><text>death results from the offense; or</text> </subparagraph><subparagraph id="HEA347D5BD592412CB9132BBCDB2283F2"><enum>(B)</enum><text>the offense includes kidnapping or an attempt to kidnap, or an attempt to kill.</text>
 </subparagraph></paragraph></subsection><subsection id="H1574EC1BD7CA41E9B0EEDC0F644AFB30"><enum>(b)</enum><header>Circumstances described</header><text>For purposes of subsection (a), the circumstances described in this subparagraph are that—</text> <paragraph id="H72991BBAD35D462A87863BF5D6AB26A7"><enum>(1)</enum><text>the conduct described in subsection (a) occurs during the course of, or as the result of, the travel of the defendant or the victim—</text>
 <subparagraph id="HD65908486B7B4195B2E638B974B683A6"><enum>(A)</enum><text>across a State line or national border; or</text> </subparagraph><subparagraph id="HB06E45524A124E8FB16A508074DEB72E"><enum>(B)</enum><text>using a channel, facility, or instrumentality of interstate or foreign commerce;</text>
 </subparagraph></paragraph><paragraph id="HA98318327B5C40AC84C0442F2ABBF6B8"><enum>(2)</enum><text>the defendant uses a channel, facility, or instrumentality of interstate or foreign commerce in connection with the conduct described in subsection (a);</text>
 </paragraph><paragraph id="H84D305C0841848A6AE28C22BF00C8F89"><enum>(3)</enum><text>in connection with the conduct described in subsection (a), the defendant employs a firearm, dangerous weapon, explosive or incendiary device, or other weapon that has traveled in interstate or foreign commerce;</text>
 </paragraph><paragraph id="H2D08A2D25B0D4C4EA00BFC03D22AF90B"><enum>(4)</enum><text>the conduct described in subsection (a)—</text> <subparagraph id="HFFFFB1A9B7E44800972FB262EDFA1977"><enum>(A)</enum><text>interferes with commercial or other economic activity in which the victim is engaged at the time of the conduct; or</text>
 </subparagraph><subparagraph id="H8AC8C974F5A34D688D28421474E39870"><enum>(B)</enum><text>otherwise affects interstate or foreign commerce; or</text> </subparagraph></paragraph><paragraph id="H7B33424440EF442F8E9344FF758CC3F9"><enum>(5)</enum><text>the victim is a Federal law enforcement officer.</text>
							</paragraph></subsection><subsection id="H4F079E1FC8E747B29C936ABEBD918789"><enum>(c)</enum><header>Certification requirement</header>
 <paragraph id="HF256D3AEB868487B8EB7F997D655B4A8"><enum>(1)</enum><header>In general</header><text>No prosecution of any offense described in this section may be undertaken by the United States, except under the certification in writing of the Attorney General, or a designee, that—</text>
 <subparagraph id="HDBB2DBF1D6A445C987B32A23D7A89DDD"><enum>(A)</enum><text>the State does not have jurisdiction;</text> </subparagraph><subparagraph id="H9927FA3ABDAB40188C6D087C586D0691"><enum>(B)</enum><text>the State has requested that the Federal Government assume jurisdiction;</text>
 </subparagraph><subparagraph id="H6CAAE238CBD54521A53236A21DBA9A1B"><enum>(C)</enum><text>the verdict or sentence obtained pursuant to State charges left demonstratively unvindicated the Federal interest in protecting the public safety; or</text>
 </subparagraph><subparagraph id="H00B4ECF3860249D6BC2989724E61488C"><enum>(D)</enum><text>a prosecution by the United States is in the public interest and necessary to secure substantial justice.</text>
 </subparagraph></paragraph><paragraph id="H7A7DB687D4DC4F49A23AAA76D1CFF65E"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to limit the authority of Federal officers, or a Federal grand jury, to investigate possible violations of this section.</text>
 </paragraph></subsection><subsection id="H24EF8D30E204483AA704495ABC1EF90D"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HCDF529BF244548CD8BBBEAFF93FA325C"><enum>(1)</enum><header>Law enforcement officer</header><text>The term <quote>law enforcement officer</quote> means an employee of a governmental or public agency who is authorized by law—</text>
 <subparagraph id="H39C87FE456DF485DA664C3C7875BE446"><enum>(A)</enum><text>to engage in or supervise the prevention, detention, investigation, or the incarceration of any person for any criminal violation of law; and</text>
 </subparagraph><subparagraph id="H0ADA3B00ACC84EB3AACE526973A4A1B9"><enum>(B)</enum><text>to apprehend or arrest a person for any criminal violation of law.</text> </subparagraph></paragraph><paragraph id="HEF806D4A89EB4E04816048F9D95B2A1A"><enum>(2)</enum><header>State</header><text>The term <quote>State</quote> means a State of the United States, the District of Columbia, or any commonwealth, territory, or possession of the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HB6C1F1FED69E4E6782BCBBB1A2D57E68"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>
