                      UNANIMOUS CONSENT AGREEMENTS

                         S. 3001 (ORDER NO. 732)

    1.--Ordered, That on Wednesday, September 10, 2008, upon the 
conclusion of Morning Business, the Senate resume consideration of S. 
3001, an original bill to authorize appropriations for fiscal year 2009 
for military activities of the Department of Defense, for military 
construction, and for defense activities of the Department of Energy, to 
prescribe military personnel strengths for such fiscal year, and for 
other purposes; provided, that the motion to recommit and pending 
amendments be set aside so that the Senate may consider the following 
first degree amendments:
        Amdt. No. 5323, offered by Mr. Levin for the Senator from 
Vermont, Mr. Leahy, re: statute of limitations
        Vitter amendment re: missile defense, with 2 hours of debate
        Nelson (FL) amendment re: SBP-DIC offset
        Kyl amendment re: X-ban radar
    Ordered further, That no amendments be in order to the above 
amendments prior to a vote; provided, that any debate time provided 
under this agreement be equally divided and controlled in the usual 
form; further, that if a sequence of votes is established under the 
provisions of a separate agreement, then there be 2 minutes of debate 
equally divided and controlled prior to any vote, and that in any 
sequence, the succeeding votes be limited to 10 minutes each.
    Ordered further, That no motions to proceed may be made during 
Wednesday's session during the pendency of S. 3001. (September 9, 2008.)

                                 S. 1974

    2.--Ordered, That S. 1974, a bill to make technical corrections 
related to the Pension Protection Act of 2006, remain at the desk. (Mar. 
31, 2008.)

                          VETO MESSAGE ON S. 5

    3.--Ordered, That the veto message on S. 5, the Stem Cell Research 
Enhancement Act of 2007, be considered as read and that it be printed in 
the Record and spread in full upon the Journal.

    4.--Ordered, That if the Senate receives from the House a message on 
H.R. 3997, an act to amend the Internal Revenue Code of 1986 to provide 
earnings assistance and tax relief to members of the uniformed services, 
volunteer firefighters, and Peace Corps volunteers, and for other 
purposes, with an amendment that is not germane to the Senate amendment 
or the underlying bill, that the bill and its amendments be referred to
