AGENCY: Federal Communications Commission.

ACTION: Proposed rule; denial of petition.

SUMMARY: This document denies the petition for reconsideration filed by

  3-J Broadcasting Company, seeking review of the action taken by the 
Chief, Allocations Branch, on July 18, 1994, returning its petition for 
rule making by letter as unacceptable for consideration. 3-J 
Broadcasting Company petitioned for a waiver of the ATV Freeze Order 
(52 FR 28346, July 29, 1987) and the allotment of Channel 38 to Bend, 
Oregon, as the community's fourth local television service. The 
Commission has determined that 3-J Broadcasting Company has not met the 
criteria for grant of its waiver request. With this action, this 
proceeding is terminated.
