GNB Industrial Battery, Inc., Civil Action No. 96-2129, was lodged on June 18, 1996, with the United States District Court for the Western District of Arkansas. The Consent Decree settles an action brought under Section 113 of the Clean Air Act (``the Act''), 42 U.S.C. 7413, and the Standards of Performance for New Stationary Sources (``NSPS''), 40 CFR Part 60, Subpart KK--Standards of Performance for Lead-Acid Battery Manufacturing Plants. The Consent Decree provides for GNB's payment of a civil penalty to the United States in the amount of $63,177.00, and requires GNB to implement and complete a Supplemental Environmental Project (``SEP'') at a cost of approximately $385,000.00. The Department of Justice will receive, for a period of thirty (30) days from the date of this publication, comments relating to the proposed Consent Decree.
