The Prospective Purchaser Agreement would resolve certain potential EPA claims under Sections 106 and 107 of the Comprehensive Environmental Response, Compensation and Liability Act of 1980, as Amended by the Superfund Amendments and Reauthorization Act of 1986 (``CERCLA''), against John McCrocklin, the prospective purchaser (``the purchaser''). The Settlement would require the purchaser to pay to EPA the sum of $150,000.00 within 120 calendar days of the effective date of the Agreement, provide EPA access to the Site, and place certain deed restrictions on the property. EPA will consider public comments on the proposed agreement for thirty (30) days. EPA may withdraw from or modify the proposed purchaser agreement should such comments disclose facts or considerations which indicate the proposed agreement is inappropriate, improper, or inadequate.
