Emergency Exemption; Issuance

    On September 26, 1996, the Fish and Wildlife Service (Service) 
published in Federal Register Vol 61, No. 188, page 50503, a notice of 
the emergency issuance of a permit (PRT-819183) to the Denver 
Zoological Gardens for the import of a captive born black rhinoceros 
(Diceros bicornis) from the Tennoji Zoological Gardens, Osaka, Japan. 
Due to health concerns at the Denver Zoological Gardens, the facility 
was unable to accept this import and on October 1, 1996, the Service 
issued a permit (PRT-820560) to allow the import of this animal to the 
AZA Rhino Advisory Group at the Caldwell Zoo, Tyler Texas. The 30 day 
public comment period required by section 10(c) of the Endangered 
Species Act was waived. The Service determined that an emergency 
affecting the survival of the rhino existed and that no reasonable 
alternative was available to the applicant as indicated in the previous 
notice.
