Aluminum Finishing Corporation, Civil Case No. IP95-1703-CD-M/S, was lodged with the United States District Court for the Southern District of Indiana, Indianapolis Division. This consent decree represents a settlement of claims against Aluminum Finishing Corporation (``AFC'') for violations of the Clean Air Act, 42 U.S.C. 7413(b), and its implementing regulations, the Indiana State Implementation Plan (``SIP''). The complaint seeks injunctive relief and civil penalties for the AFC's operation of a metal parts and products coating operation in Indianapolis, Indiana, at which it caused, allowed or permitted the continued discharge of volatile organic compounds in excess of the emission limitations set forth in the Indiana SIP, in continued violation of the Clean Air Act and the Indiana SIP. Under this settlement, AFC will pay the United States a civil penalty of [[Page 7255]] $50,000. In addition, the Consent Decree requires AFC to comply with the Clean Air Act and, in particular, to install and operate a thermal oxidizer to eliminate AFC's discharges of excess volatile organic compounds. The consent decree also requires monitoring, reporting and recordkeeping to ensure AFC will continue to comply and allow EPA to monitor AFC's compliance. The Department of Justice will receive for a period of thirty (30) days from the date of this publication comments relating to the proposed Consent Decree.
