This proposed consent decree would resolve the United States' civil claims against The Sherwin-Williams Company under Subchapter III of the Resource Conservation and Recovery Act (``RCRA''), as amended, 42 U.S.C. 6921 et seq.; the Clean Water Act, as amended, 33 U.S.c. 1251 et seq.; the Clean Air Act, as amended, 42 U.S.C. Secs. 7401 et seq.; Subchapter IX of RCRA, 42 U.S.C. 6991 et seq.; and the Emergency Planning and Community Right to Know Act, 42 U.S.C. 11001 et seq. Under the terms of the proposed consent decree, Sherwin-Williams will pay a civil penalty of $4.7 million, perform supplemental environmental projects that will cost the company a total of $1.1 million, undertake a corrective action to investigate and remediate contamination to the soil and groundwater at and emanating from the [[Page 7474]] company's Chicago facility, and perform other injunctive relief. The Department of Justice will receive, for a period of thirty (30) days from the date of this publication, comments relating to the proposed consent decree.
