Sec. 9622(d)(2), notice is hereby given that on April 8, 1997, a Consent Decree was lodged in United States v. Kennecott Holdings Corporation, et al., Civil Action No. 97-39-BLG-JDS with the United States District Court for the District of Montana. The Complaint in this case was filed with Section 107 of the Comprehensive Environmental Response, Compensation and Liability Act of 1980, as amended (``CERCLA''), 42 U.S.C. Sec. 9607, with respect to the McLaren Tailings Superfund Site located in Park County, Montana against Kennecott Holdings Corporation and Kennecott Montana Company. Pursuant to the terms of the Consent Decree, which resolves claims under the above-mentioned statute and under Section 7003 of the Resource Conservation and Recovery Act (RCRA), 42 U.S.C. Sec. 6973, the settling defendants will covenant not to seek reimbursement of response costs incurred at the Site from the United States and the United States covenants not to sue the settling defendants for response costs incurred by the United States at the Site. The Department of Justice will receive comments relating to the proposed Consent Decree for a period of thirty days from the date of publication of this notice. Comments should be addressed to the Assistant Attorney General, Environment and Natural Resources Division, Department of Justice, Washington, D.C. 20530, and should refer to United States v. Kennecott Holdings Corporation, et. al., DOJ Ref. No. 90-11-3-1644. Commenters may request an opportunity for a public meeting in the affected area, in accordance with Section 7003(d) of RCRA. The proposed Consent Decree may be examined at the office of the United States Attorney, District of Montana, 2929 3rd Avenue North, Suite 400, Billings, Montana 59103 or at the offices of the Environmental Protection Agency, Region VIII, 999 18th Street, Suite 500, Denver, Colorado, 80202.
