RIN 2120-AF08

Training and Qualification Requirements for Check Airmen and
Flight Instructors: Correction and Editorial Changes

AGENCY: Federal Aviation Administration (FAA), DOT.

ACTION: Final rule; correction.

-----------------------------------------------------------------------

SUMMARY: This amendment makes corrections and minor editorial changes
to regulations published on June 17, 1996 (61 FR 30734). This amendment
will not impose any additional restrictions on persons affected by
these regulations. The final rule published on June 17, 1996,
established separate requirements for check airmen who check only in
flight simulators and flight instructors who instruct only in flight
simulators. In addition this rule allows check airmen and flight
instructors to obtain all of their flight training in simulators, as
opposed to the current scheme in which initial and transition flight
training must include an in-flight element.

EFFECTIVE DATE: April 28, 1997.

SUPPLEMENTARY INFORMATION:

Background

On June 17, 1996, the FAA published a regulation that established
separate requirements for check airmen who check only in flight
simulators and flight instructors who instruct only in flight
simulators. A reference to Sec. 121.411 in current Sec. 121.409(b)(4)
is no longer appropriate. Flight instructor qualification requirements
have been moved to new Sec. 121.412. This correction will change the
reference in Sec. 121.409(b)(4) to Sec. 121.412.
It was the intent of this rule to have the requirements of
Sec. 121.412(e) virtually identical to those in Sec. 121.411(e). Upon
further review there appears to be a difference between Sec. 121.411(e)
and Sec. 121.412(e) in that Sec. 121.412(e) prohibits a flight
instructor who has reached his or her 60th birthday from serving as an
instructor. By this correction, the requirements will be identical.
Under Sec. 121.413(d), the last word of the paragraph was rendered as
``transaction'' instead of ``transition'' as the FAA had specified.
