(TTI), a noncarrier, has filed a verified notice of exemption under 49 CFR 1150.31 to acquire from The Burlington Northern and Santa Fe Railway Company and to operate approximately 19.70 miles of rail line between Creston, IA, milepost 1.45, and the end of the line at Greenfield, IA, milepost 21.15. TTI reports that it purchased the line on June 11, 1997, but the earliest the transaction could be consummated pursuant to the exemption was August 29, 1997, the effective date of the exemption (7 days after the August 22, 1997 filing date). If the verified notice contains false or misleading information, the exemption is void ab initio. Petitions to reopen the proceeding to revoke the exemption under 49 U.S.C. 10502(d) may be filed at any time. The filing of a petition to revoke will not automatically stay the transaction.
