Description of Project: The project as licensed consists of the following features: (1) Three concrete overflow dams, each about ten feet high, with a total length of 231 feet, each having a crest elevation of about 132.78 feet mean sea level (msl) surmounted by 1.5- foot-high flashboards, and a 29-foot-long, non-overflow dam; (2) an 8.8-mile long, 133 acre surface area reservoir having a 200 acre-foot useable storage capacity at normal water surface elevation of 134.28 feet msl; (3) the north forebay with trashracks, headgates and two 7- foot-diameter steel penstocks; (4) the north powerhouse known as Plant 9B, having a 1,000-KW generating unit; (5) the south forebay, with trashracks, headgates, two surge tanks, and two 10-foot-diameter penstocks; (6) the south powerhouse, known as Plant 9, having two 700- kW generating units; (7) the generator leads from Plant 9 to the Vergennes Substation and the 950-foot-long, 2,400-volt overhead generator leads from Plant 9B to the Vergennes Substation; and (8) appurtenant facilities. The Applicant is not proposing any changes to the existing project works as licensed. The Applicant estimates the project's average annual generation would be 9.455 Mwh and the Applicant owns all the existing project facilities. m. Purpose of Project: All project energy generated would be sold to commercial and residential customers within the Applicant's own regional transmission and distribution system. n. Protests or Motions to Intervene--Anyone may submit a protest or a motion to intervene in accordance with the requirements of Rules of Practice and Procedure, 18 CFR 385.210, 385.211, and 385.214. In determining the appropriate action to take, the Commission will consider all protests filed, but only those who file a motion to intervene in accordance with the Commission's Rules may become a party to the proceeding. Any protests or motions to intervene must be received on or before the specified deadline date for the particular application. E. Filing and Service of Responsive Documents--The application is not ready for environmental analysis at this time; therefore, the Commission is not now requesting comments, recommendations, terms and conditions, or prescriptions. When the application is ready for environmental analysis, the Commission will notify all persons on the service list and affected resource agencies and Indian tribes. If any person wishes to be placed on the service list, a motion to intervene must be filed by the specified deadline date herein for such motions. All resource agencies and Indian tribes that have official responsibilities that may be affected by the issues addressed in this proceeding, and persons on the service list will be able to file comments, terms and conditions, and prescriptions within 60 days of the date the Commission issues a notification letter that the application is ready for an environmental analysis. All reply comments must be filed with the Commission within 105 days from the date of that letter. All filings must (1) bear in all capital letters the title ``PROTEST'' or ``MOTION TO INTERVENE;'' (2) set forth in the heading the name of the applicant and the project number of the application to which the filing responds; (3) furnish the name, address, and telephone number of the person protesting or intervening; and (4) otherwise comply with the requirements of 18 CFR 385.2001 through 385.2005.
