Activities: Proposed Collection; Comment Request

ACTION: Notice of Information Collection Under Review: Reinstatement, 
with change, of previously approved collection for which approval has 
expired.

National Survey of Indigent Defense Systems

    The proposed information collection is published to obtain comments 
from the public and affected agencies. Comments are encouraged and will 
be accepted until June 15, 1998. Request written comments and 
suggestions from the public and affected agencies concerning the 
proposed collection of information. Your comments should address one or 
more of the following four points:
    (1) Evaluate whether the proposed collection of information is 
necessary for the proper performance of the functions of the agency, 
including whether the information will have practical utility;
    (2) Evaluate the accuracy of the agencies estimate of the burden of 
the proposed collection of information, including the validity of the 
methodology and assumptions used;
    (3) Enhance the quality, utility, and clarity of the information to 
be collected; and
    (4) Minimize the burden of the collection of information on those 
who are to respond, including through the use of appropriate automated, 
electronic, mechanical, or other technological collection techniques or 
other forms of information technology, e.g., permitting electronic 
submission of responses.

Overview of This Information Collection

    (1) Type of information collection: Reinstatment, with change, of a 
previously approved collection for which approval has expired.
    (2) The title of the form/collection: National Study of Indigent 
Defense Systems.
    (3) The agency form number, if any, and the applicable component of 
the Department sponsoring the collection: Previous OMB number was 1121-
0095. The agency form number is NSID-2. Bureau of Justice Statistics, 
United States Department of Justice.
    (4) Affected public who will be asked or required to respond, as 
well as a brief abstract: Primary: State and local providers of 
indigent defense services including selected county officials to 
identify indigent defense programs.
    Other: None.
    This information collection will identify the number and 
characteristics of public defense organizations and agencies and 
measure the way in which States provide legal services for indigent 
criminal defendants, their caseloads, policies and practices. 
Information also will be gathered on type of offenses represented, 
expenditures, funding sources and other related administrative issues. 
The information collected will provide a comprehensive portrait of 
state and local efforts to meet the needs of indigent criminal 
defendants.
    (5) An estimate of the total number of respondents and the amount 
of time estimated for an average respondent to respond: An estimated 
1,500 respondents for the data collection period of July 1998 to July 
1999. Completion of data form is estimated at 1.5 hours.
    (6) An estimate of the total public burden (in hours) associated 
with the collection: 2250.00 total burden hours for the data 
collection.
