ACTION: Semiannual regulatory agenda.

SUMMARY: This notice provides the semiannual agenda of rules scheduled
for review or development between fall 2006 and spring 2007. The
Regulatory Flexibility Act and Executive Order 12866 require
publication of the agenda.

SUPPLEMENTARY INFORMATION: With this publication, the Department
satisfies the requirement of Executive Order 12866 that the Department
publish an agenda of rules that we have issued or expect to issue and
of currently effective rules that we have scheduled for review.
Simultaneously, the Department meets the requirement of the Regulatory
Flexibility Act (5 U.S.C. 601 et seq.) to publish an agenda in April
and October of each year identifying rules that will have significant
economic effects on a substantial number of small entities. We have
specifically identified in the agenda rules that will have such
effects.
For this edition of the Department's regulatory agenda, we have
included the most important significant regulatory actions in the
Regulatory Plan, which appears in part II of today's Federal Register.
The Table of Contents below lists the Regulatory Plan entries and
denotes them by a bracketed bold reference that directs the reader to
the appropriate Sequence Number in part II.

regulations. By converting the Departmental NEPA procedures from the DM
to new regulations the Department intends to promote greater

CERCLA requires that Natural Resource Damage Assessment Regulations be
promulgated and that the regulations be reviewed, and revised as
appropriate, every 2 years. This rulemaking is the biennial review of
the administrative process for conducting assessments as well as the
so-called type B procedures for determining injury and damages through
scientific and economic studies. This rulemaking will also address the
calculation of lost non-use values of natural resources, in compliance
with State of Ohio v. Department of the Interior, 880 F.2d 432 (D.C.
Cir. 1989), which ordered the Department to allow for the assessment of
all reliably calculated values lost as a result of a natural resource
injury.

habitats in Afghanistan, India, Pakistan, Tajikistan, Turkmenistan, and

Abstract: We propose to list the following six foreign bird species
under the Endangered Species Act: the black stilt (Himantopus
novaezelandiae) of New Zealand; Caerulean Paradise-flycatcher
(Eutrichomyias rowleyi) of Sulawesi, Indonesia; giant ibis (Pseudibis
gigantea) of southern Laos and northern and eastern Cambodia; Gurney's
pitta (Pitta gurneyi) of southern Thailand; Long-legged warbler, also
known as the long-legged thicketbird (Trichocichla rufa), of Viti Levu,
Fiji; and Socorro mockingbird (Mimodes graysoni) of Revillagigedo
Islands, Mexico.

Abstract: We propose a plain-language revision of 50 CFR 20.134 to make
it easier for the public to read and understand. The language governing
determination of Expected Environmental Concentrations (EEC) in
terrestrial and aquatic ecosystems would be altered to make clear the
shot size and number of shot to be used in calculating the EECs. We
also plan to add language specifying the pH levels to be used in
calculating the EEC in water.

Abstract: This draft Service Manual chapter (606 FW 2) provides policy
for refuge managers to apply when determining how and when mosquito
populations may be managed on lands administered within the National
Wildlife Refuge System. This draft chapter is based on science and
includes a requirement for data-gathering both prior to and after
management actions. The draft chapter also includes a provision for
actions taken during emergencies. This chapter applies to all units of
the Refuge System where we have jurisdiction over such actions, whether
mosquito management is performed by the Service or by an outside
agency.

and shellfish taking regulations included in the ``Subsistence

March 31, 2008. This rule would also amend the Customary and
Traditional Use Determinations of the Federal Subsistence Board and the

Abstract: This rule would establish regulations for fishing seasons,

rulemaking is necessary because subpart D is subject to an annual
public review cycle. When final, this rulemaking would replace the fish
and shellfish taking regulations included in subpart D, Subsistence
Taking of Fish and Wildlife Regulations, which expire on March 31,
2007. This rule would also amend the Customary and Traditional Use
Determinations of the Federal Subsistence Board and the General
Regulations related to the taking of fish and shellfish.

time.

penicillatus), Ochlockonee moccasinshell (Medionidus simpsonianus), and
oval pigtoe (Pleurobema pyriforme), and two threatened freshwater
mussels: the Chipola slabshell (Elliptio chipolaensis) and purple
bankclimber (Elliptoideus sloatianus). If prudent, we will designate
critical habitat. These mussels occur in drainages that include the
