MEMORANDUM OPINION AND ORDER granting in part and denying in part 30 MOTION for Summary Judgment filed by The City of Dothan, Alabama; that said motion is GRANTED in relation to Plaintiff's Fourth Amendment and First Amendment claims, brought under Section 1983, as well as his malicious prosecution claim; that said motion is DENIED in all other respects. Consequently, Plaintiff's state law claims of false imprisonment and negligent, wanton, willful hiring, training and supervision alleged against the City of Dothan shall proceed to trial. Denying 28 MOTION for Summary Judgment filed by Clark Allums. Consequently, Plaintiff's Fourth Amendment and FirstAmendment claims, brought under Section 1983, as well as his false imprisonment and malicious prosecution claims under state law, alleged against Officer Clark Allums, in his individual capacity, shall proceed to trial.
