RECOMMENDATION of the Magistrate Judge that: (1) the 24 Motion for summary judgment regarding the plaintiff's claims for monetary damages against the defendants in their official capacities be granted as the defendants are entitled to absolute immunity from these claims; (2) the 24 motion for summary judgment filed on behalf of defendant Lamar Glover with respect to the plaintiff's excessive force and medical treatment claims be presented against this defendant in his individual capacity be granted; (3) the 24 motion for summary judgment be granted in favor of defendants Darla Speigner, Valerie Hathaway and Laura Laguerra as to the plaintiff's claim of inadequate medical treatment lodged against them in their individual capacities; (4) the 24 motion for summary judgment regarding the plaintiff's excessive force claim against defendant Ellis Rodgers in his individual capacity be denied; (5) the plaintiff's excessive force claim against defendant Ellis Rodgers in his individual capacity be set for a jury trial.
