MEMORANDUM OPINION AND ORDER, grantin in part and denying in part 1 MOTION to Dismiss filed by Alabama Department of Public Safety,, Michael Robinson,, W. M. Coppage,, Danny Hester,, Herman Wright,, Byron D. Prescott,, Neil Tew; Dfts' motion to dismiss all claims brought against the Alabama Dept of Public Safety be and the same is hereby granted and the Alabama Dept of Public Safety is hereby dismissed as a dft in this lawsuit; 2) Dfts' motiont o dismiss the federal-law claims in Counts One, Two, Three and Fourt against dft W.M.Coppage in his official capacity be and the same is hereby granted; 3) Dfts' motion to dismiss Plaintiff's claim in Count Two that Dfts W.M. Coppage, Herman Wright, Danny Hester, Byron D. "Pete" Prescott, Neit Tew and Michael Robinson deprived him of a liberty interest protected by the Fourteenth Amendment's Due Process Clause be and the same is hereby granted; 4) Dfts' motion to dimiss the 1983 First Amendment and Fourteenth Amendment Equal Protection individual-capacity claims in Counts One and Three against Dfts W.M. Coppage, Herman Wright, Danny Hestor, Byron D. "Pete" Prescott, Neil Tew and Michael Robinson be and the same is hereby denied at this time; Plaintiff is granted leave until 6/25/07, to move to amend his complaint to allege claims which comply with the applicable heightened pleading requirements; Any amended complaint shall be accompanied by a motion for leave to amend, shall comply with this District's local rules for the filing of amendments, and shall not restate claims which have been dismissed by the terms of this order as further set out in order; 5) Dfts' motion to dismiss the 42 USC 1985 claim in Count Four be and the same is hereby denied; 6) Dfts' motion to dismiss the state-law causes of action in Counts Five, Six and Seven be and the same is hereby denied.
