MEMORANDUM OPINION AND ORDER as follows: (1) The 68 Motion for Summary Judgment is GRANTED. (2) Plaintiff's claims in this case against Defendants PCBOE, Bazzell, Pyron, Casey, and McDaniel are DISMISSED WITH PREJUDICE. (3) Jury Trial set for 7/14/2008 is CANCELLED. (4) On or before 7/7/2008, Plaintiff shall file a legal memorandum and proper certification in support of the fees and expenses he seeks as part of his award as further set out in the order. (5) Defendant Coon shall be allowed to dispute any claim for attorneys fees and costs by filing an objection with a brief and legal authority on or before 7/21/2008. FINAL JUDGMENT as follows: (1) with respect to all claims in this action by plaintiff J. R. against defendant Charles Leslie Coon, judgment is entered in favor of plaintiff and against Coon in the amount of $219,730.00 in compensatory damages and $659,190.00 in punitive damages; (2) with respect to the prosecution of plaintiff's claims against Coon, costs are taxed against Coon, for which execution may issue; (3) as part of this judgment, plaintiff is entitled to an award of attorneys fees and expenses pursuant to 42 USC 1988. With respect to plaintiff's attorney Susan Shirlock DePaola, Coon shall pay $14,612.50 in fees and $1,012.14 in expenses. With respect to plaintiff's attorney Deanie C. Allen, Coon shall pay $9,310.00 in fees and $2,067.55 in expenses; (4) with respect to all claims by plaintiff against defendants Samuel Mark Bazzell, Terry Casey, Buddy Pyron, Robert McDaniel, and the Pike County Board of Education, judgment is entered in favor of the defendants, with plaintiff taking nothing by his claims; (5) with respect to all claims by plaintiff against defendants other than Coon, costs are taxed against plaintiff, for which execution may issue; (6) the clerk of court is directed to enter this document on the civil docket sheet as a Final Judgment pursuant to Rule 58 of the FRCP and to close this file.
