MEMORANDUM OPINION AND ORDER as follows: (1) the 33 MOTION to Dismiss is denied as to the claim for abnormally dangerous activity in Count VII of the complaint; (2) the 33 motion to dismiss is granted with prejudice as to the negligence per se claim in Count VI of the complaint; (3) the 33 motion to dismiss is granted without prejudice as to the remaining claims.
