JUDGMENT: it is the ORDER, JUDGMENT, and DECREE of the court as follows: (1) The US Magistrate Judge's 25 recommendation is adopted to the extent it recommends that plf's case be dismissed without prejudice; (2) This lawsuit is dismissed without prejudice because plf has abandoned it; (3) Dfts' 15 motion to dismiss is denied as moot; further ORDERED that costs are taxed against plf, for which execution may issue; DIRECTING the clerk to enter this document on the civil docket as a final judgment pursuant to Rule 58 FRCP; This case is closed.
