RECOMMENDATION OF THE MAGISTRATE JUDGE: The court will treat Defendants' reports as a motion for summary judgment, and the court concludes that this motion is due to be resolved in favor of Defendants. It is the RECOMMENDATION of the Magistrate Judge that: 1. The motions for summary judgment on behalf of the defendants be GRANTED; 2. This case be dismissed without prejudice under Heck v. Humphrey.
