MEMORANDUM OPINION AND ORDER: 1) The 62 Motion for Partial Summary Judgment is GRANTED and judgment is entered in favor of Wheeler Bros., Inc. and against Robert L. Jones, Jr. and Advanced Fleet Services, LLC pursuant to the Parts Agreement and Personal Guaranty in the amount of $794,530.13 plus interest at the rate of five percent per month and attorneys' fees to be determined at the conclusion of the case; 2) The 66 Motion for Summary Judgment of Less Than All Dfts is DENIED; 3) The 67 Motion for Summary Judgment filed by Dft Virginia Jones is GRANTED and Judgment is entered in favor of Virginia Jones and against Wheeler Bros. to the extent that insurance premiums are exempt under Alabama law as compensation to Robert Jones, Jr.. RECOMMENDATION OF THE MAGISTRATE JUDGE that Plaintiff Wheeler Bros, Inc.'s Motion for Writ of Execution or Charging Order (Doc. 221) filed 3/28/2018 be GRANTED. It is further the RECOMMENDATION that an Order be entered by the District Judge in this matter which states as follows: This matter is pending before the Court on Plaintiff's Motion for Writ of Execution or Charging Order (Doc. 221). For good cause shown, it is ORDERED that the Motion (Doc. 221) be GRANTED and that financial interest of Defendant Robert L. Jones, Sr. in Best Buy Automotive and Tires, LLC, be charged with the payment of the unsatisfied amount of the judgment, accrued interest thereon, and that Best Buy Automotive and Tires, LLC, shall report to Counsel for Plaintiff each time a distribution is made with respect to any financial interest, listing the amount and time of all distributions made at the time or in connection with that distribution, and distributing to Counsel for the plaintiff any amounts that otherwise become due or distributable to the Defendant Robert LJones., Sr. to be credited against the judgment balances.
