JUDGMENT: it is the ORDER, JUDGMENT, and DECREE of the court as follows: (1) Plaintiff's 18 objections are overruled. (2) The United States Magistrate Judge's 17 recommendation is adopted. (3) Sams Club, Inc./Wal-Mart, Inc.'s 6 motion to dismiss is granted without prejudice as to plaintiff's claims against Wal-Mart, Inc. in Counts I and IV-VI and denied as to plaintiff's claim of race discrimination against Wal-Mart, Inc. in Count II. (4) Defendant Ewuvonka Flournoy's 7 motion to dismiss is granted as to Counts I-V with prejudice, and is granted as to Count VI without prejudice. (5) Plaintiff's 18 motion for leave to amend the complaint is left for resolution by the magistrate judge. (6) No costs are taxed. The clerk of the court is DIRECTED to enter this document on the civil docket as a final judgment pursuant to Rule 58 of the Federal Rules of Civil Procedure.
