MEMORANDUM OPINION AND ORDER: Accordingly, for the reasons as stated and for good cause, it is ORDERED as follows: 1. That the motion to intervene (doc. # 33) be and is hereby GRANTED and the American Academy of Pediatrics, the American Cancer Society Cancer Action Network, the American Heart Association, the American Lung Association, the Campaign for Tobacco- Free Kids, and the Truth Initiative be and are hereby PERMITTED to intervene as defendants in this action; 2. That the parties joint motion to stay case (doc. # 54) be and is hereby GRANTED and that this case be and is hereby STAYED pending a decision by the United States Court of Appeal for the District of Columbia Circuit in Nicopure Labs LLC v. FDA, 266 F. Supp. 3d 360 (D.C. 2017) appeal docketed No. 17-5196 (D.C. Cir. Aug. 31, 2017); 3. The parties are DIRECTED to file a joint status report within forty-five (45) days of the date of a decision issued by the United States Court of Appeal for the District of Columbia Circuit in Nicopure Labs LLC v. FDA, 266 F. Supp. 3d 360 (D.C. 2017) appeal docketed No. 17-5196 (D.C. Cir. Aug. 31, 2017); and 4. That the motion to vacate the briefing schedule (doc. # 54) be and is hereby DENIED as moot.
