REPORT AND RECOMMENDATION OF THE MAGISTRATE JUDGE: the undersigned Magistrate Judge recommends as follows: 1) That Walmart's 57 motion for judgment on the pleadings be GRANTED in part and DENIED in part; 2) That Walmart's 57 motion for summary judgment be GRANTED, and that all claims asserted by Plf Morris Sanders be DISMISSED with prejudice; 3) That the objections contained in the 71 motion to strike be SUSTAINED in part and OVERRULED in part, as set forth herein; and 4) That this case be deconsolidated by the Clerk of Court before a final judgment is entered; Objections to R&R due by 2/2/2018. ORDER: it is ORDERED that: 1) The 79 Recommendation of the Magistrate Judge is ADOPTED; 2) Dft's 57 motion for judgment on the pleadings is GRANTED as to Plf's Title VII race discrimination claim of the 24 Amended Complaint; 3) Dft's 71 objection to paragraph 9 of Plf's 69-1 affidavit is SUSTAINED, and all other objections are OVERRULED; and 4) Dft's 57 motion for summary judgment is GRANTED as to Plf's claims under the Americans with Disabilities Act, the Family and Medical Leave Act, and the Title VII claims in Plf's EEOC Complaint; 5) All of Plf's claims are DISMISSED with prejudice; 6) All other pending motions are DENIED as moot.
