JUDGMENT: In accordance with the memorandum opinion entered today, it is the ORDER, JUDGMENT, and DECREE of the court as follows: (1) Defendant Tai Q. Chungs motions to dismiss (doc. nos. 100-1 & 107) are granted. (2) Plaintiff Avery L. Smiths constitutional claims against defendant Chung are dismissed with prejudice, and defendant Chung is terminated as a party to this action. No costs are taxed. The clerk of the court is DIRECTED to enter this document on the civil docket as a final judgment pursuant to Rule 58 of the Federal Rules of Civil Procedure.
