JUDGMENT it is the Order, Judgment, and Decree of the court as follows: 1) Adopting 18 REPORT AND RECOMMENDATIONS re MOTION for Summary Judgment filed by Matthew W. Gagne; Granting 8 MOTION for Summary Judgment filed by Matthew W. Gagne as to plaintiff's federal claims; 3) Judgment is entered in favor of defendant and against plaintiff on plaintiff's federal claims, with plaintiff taking nothing by these claims; Plaintiff's state-law claims are dismissed without prejudice pursuant to 28 USC 1367; It is further Ordered that costs are taxed against plaintiff, for which execution may issue; The clerk of the court is directed to enter this document on the civil docket as a final judgment pursuant to Rule 58 of the FRCP.
