MEMORANDUM OPINION AND ORDER directing as follows: 1) Even assuming arguendo that the 2 Motion for Leave to Proceed In Forma Pauperis is due to be GRANTED to the extent that Plf Gene Coggins' Complaint could be filed without the prepayment of fees, Plf Gene Coggins' Complaint is hereby DISMISSED prior to service on Dft pursuant to 28 USC 1915(e)(2)(B)(i)-(iii); 2) The 3 Motion to Use the Appendix System is DENIED as it is without merit.
