ORDER AND RECOMMENDATION OF THE MAGISTRATE JUDGE: it is ORDERED as follows: 1) Wells Fargo's objections to Mathews' evidentiary submissions are OVERRULED; 2) Mathews' 60 motion to strike and for sanctions is DENIED; 3) Any claims improperly raised by Mathews for the first time in her summary judgment filings, including her claims for Fourteenth Amendment due process and equal protection violations, civil conspiracy, and retaliation and hostile work environment based on her refusal to participate in fraudulent sales practices, are not considered by the court on summary judgment; The undersigned further RECOMMENDS that, for the reasons stated above: 1) Wells Fargo's 54 motion for summary judgment be GRANTED in its entirety; and 2) Mathews' 50 motion for summary judgment be DENIED in its entirety; Objections to R&R due by 11/29/2017. JUDGMENT: it is the ORDER, JUDGMENT, and DECREE of the court as follows: (1) Plf's 65 objections are overruled; (2) The US Magistrate Judge's 62 recommendation is adopted; (3) Plf's 05 motion for summary judgment is denied; (4) Dft's 54 motion for summary judgment is granted; (5) Judgment is entered in favor of dft and against plf, with plf taking nothing by her complaint; further ORDERED that costs are taxed against plf, for which execution may issue; DIRECTING the clerk to enter this document on the civil docket as a final judgment pursuant to Rule 58 FRCP; This case is closed.
