RECOMMENDATION OF THE MAGISTRATE JUDGE: it is the RECOMMENDATION of the Magistrate Judge that: 1) The claims against Ki-Shawn Powell be dismissed without prejudice in accordance with the provisions of Rule 4(m), FRCP as service has not been effected on Powell; 2) Ki-Shawn Powell be dismissed as a party to this cause of action; 3) This case be referred back to the undersigned for additional proceedings against the remaining dfts; Objections to R&R due by 5/8/2018.
