JUDGMENT as to William R. Jewett, Jr. Defendant was sentenced to the custody of the Bureau of Prisons for a term of 76 months. Said term consists of 38 months, as to Count 2 of 09-00076 and 38 months, as to Count 1 of 10-00019; said terms to run consecutively to each other. SRT 3 years, as to Count 2 of 09-00076 and 3 years, as to Count 1 of 10-00019; said terms to run concurrently. No fine was imposed. A $100 special monetary assessment was imposed as to Count 2 of 09-00076 and as to Count 1 of 10-00019; for a total SMA of $200. Counts 1 and 3 of the superseding indictment dismissed. Jewett, Jr. The Magistrate Judge RECOMMENDS that Grounds 2 and 3 of Jewetts identical § 2255 petitions (Criminal No. 09-76, Doc. 76; Criminal No. 10-19, Doc. 22) be DENIED and that the Court find that he is not entitled to a certificate of appealability and is therefore not entitled to appeal in forma pauperis as to those grounds.
